Sold item on Ebay, buyer requested refund.Paypal refunded without return of item

Paypal says it has seller protection, what a lie. I sold an item on Ebay, the buyer requested a refund, the excuse being the size was wrong. The item was description was detailed with measurements. I did not deny a refund-but asked the buyer to return the item for a refund. The next day a case was opened on PP. I responded ( I was told by a rep. that I had jumped the gun) and offered the same response service in returning the item for the purchase price of $200 ( s/H is buyers responsibility) because of this $6.80 difference, PP refunded the money because PP ( ASSUMES) it is an agreement between the buyer and seller that because the buyer accepts the refund amount, that the item does not need to be returned.i contacted PP, I was told to " work it out with the buyer". I tried to contact the buyer to return the item but he does not respond. PayPal has been absolutely useless in resolving this issue. PP should have a minimum % feature for automatic and authorized refund amounts. In my case the refunded price was a fraction of the cost of the item and should not have been refund without my approval. I can understand if it was damaged , and I refunded the cost of a repair and the buyer accepted- but it wouldn't be the cost of the item. PayPal is allowing fraudulent behavior and does not discourage this from happening. Although they did offer to SEND A MESSAGE to the buyer requesting the return of the item. Can anyone respond to what they think the outcome will be??? I ve contacted IC3 (Internet crimes) hopefully there can be some resolution there.

If it is SNAD, then a return is required for a required.  You'll need to call PayPal customer service and get an American rep to look over your case again.  PayPal is supposed to decide in buyer's favor and request that buyer to return item.  I think when you said PayPal said you jumped the gun, I think you meant, PayPal Resolution dept jumped the gun.

On eBay, they have the money back guarantee.  If it is something you did wrong, like, not as described, you are forced to pay return shipping and refund in whole, the entire amount paid.  If it buyer wants to return and it's nothing you did wrong, they pay for return shipping, if they chose the correct reason when requestin a return that is.  The privilege gets abused big time on eBay or course.

Kudos & Solved are greatly appreciated. 🙂

if you want to continue selling on Ebay and accepting Paypal payment,be familiar with how you should respond when a case is open, either on Ebay,PAYPAL or with buyer cc issuer.

all the emailing back and forth should take place within the case, not outside.and you are given x number of days to respond, and both buyer and seller can esclate to get Ebay and Paypal involved.

If seller esclate to Ebay involved,it is one strike against you,

If an INAD case is open on Ebay AND BUYER WINS,Ebay will send him a shipping label and bill the cost to seller acount.

If your policy is no return and buyer wins, then Ebay will just refund in full and let him keep the item.

If the case is open on Paypal, and he wins,he pays return shipping, upload tracking and then when tracking shows delivered, you or Paypal can close the case and money will go back to the buyer.

It is hard to win item not as described case as it is a he says, she says situation,so best is to allow him to return the item,if he loses on Ebay and Paypal,he will go to his cc issuer, then you are looking at losing the item, shipping and a $20 chargeback fee.

Now buyer has the item and the money, try sending him a paypal money request, word it in such a way that he has the item,he should pay or else!!

USPS has a fraud division and this is theft, also you can contact his local police ,word it in such a way it is authoratative but not menacing.

Ill try that, but as it is, I could not have been more precise in my wording as I know there are some that will nit pick and say-

""'Thats not how I interpreted it""" and use that as an excuse to not adhere to rules of conduct within the stated policy.

The buyer was not happy with the item, gave a generic reson for wanting a return/refund-which I did not argue, but did explain that item was authentic and that within DESCRIPTION of auction for the item, nothing was misrepresented(actual size , conversion size) and measurements were listed with multiple photos showing new condition of item, interior tags, price tag(which also shows as BURBERRY CHILDRENS and size as 14Y) I did make a mistake on the title as I did have size as XS- (But the description is correct)Buyer felt that this was misleading.

Ebay the request for a return, as I did not refuse the return, there was no reason for him to escalate on PP.

Below is the actual description from the listing:

For your consideration is an authentic BURBERRY Mini-Westbury size 14Y

This is about an adults xs

Original price is $220.

Tried on, but not worn outside.
Approx. Measurements are;
Pit -Pit. 17" buttoned
Pit to hem. 16 1/2"
Jacket comes in plastic shipping garment protector.
Original tags and extra button
Spare no luxury with this signature quilted jacket from Burberry.
Quilted black with signature check revers and lining.
Spread collar; button front.
Long sleeves.
Patch pockets on front.
Straight silhouette.
Polyester.

Imported

It is actually 14Y that I meant to put as 14Y/XS in the title, because 14Y fits as womens XS as other listings have as well

The jacket title is BURBERRY MINI WESTBURY DIAMOND QUILTED JACKET, so even in the title no adult jacket is listed as MINI.

The buyer started in

He even stated in one comment in PP disputes that "he just wanted to return the item for a refund" ,of which he has yet to do.

As a buyer, I always read descriptions and ask multiple questions prior to bidding. As I believe, many times a price will reflect condition of an item. With this being said=Has anyone ever come across an authentic adult Burberry jacket in good condition at $200 (without multiple bidders)? Childrens Burberry generally start at $225- and up. This buyer did not read the description or ask any questions prior to bidding. This is not a new buyer, I discribed the item in detail and also included close up photos that could be enlarged to show detail. Any bidder, if not satisfied with the photos should certainly know to read descriptions and ask questions  prior to bidding.

His bid was a winning bid-not a buy it now price. No one can tell others how to bid on auctions, this plays out as a scheme from the buyer (who is a plastic surgeon in Edinburg Texas, the item was shipped to a building with his name on it) who may feel entitled to take what he wants when not satisfied, even though he made the mistake of not reading before buying.

Still don't get why PayPal refunded without ordering the buyer to return the item.  You said to the buyer return for refund of item price.  So, I went back and re-read and re-read your first post.  I suspect you made a error in the dispute.  In the interface somewhere along the dispute, it gives you the option to offer a refund or a partial refund to the buyer and the buyer accepted so it essentially closed out the case and refunded the buyer without them returning the item. You were supposed to escalate the dispute to a claim and have PayPal find in favor of the buyer and order a return of the item in order to receive refund.  So PayPal saying that YOU jumped the gun is clear now.  I do not think it is anything the buyer did.  You did something to give this money back without return.  It is the only explanation.

That's what they say, but I did respond to buyer that the item was to be returned on dispute page. I still believe that paypal should have a minimum or max for automatic refund and have the release of funds finalized by whomever is releasing the funds. The refund was for 95% of PP charge, 100% of ebay purchase price. I'm just really frustrated...........

YOUR Item is not as described, many go for size and you said your size is wrong.

if y our policy is no return or you do not respond to the case in timely manner, robot will close the case and refund him.

you must respond within the case, not outside emailing back and forth.

it does not matter if your size is correct or not,if you have a return policy, she should be able to return it without opening a case.

There was no reason to open a case, The description is clear as were the photos that were included in the listing.

The buyer was offered the refund as requested upon return or the item. There was no reason for the buyer to open a case in Paypal. And I stand by that because I did not refuse in anyway a refund, condition being -to return the item.

Whether you want to believe there was a reason for the dispute is irrelevant.  Buyers can and will initiate disputes when issues cannot be resolved with seller.  It all part of business and the risk of selling online.

There is no need to hash and rehash this case of what you said, what you describe, return is part of retail business.

If you feel Paypal did not handle it right, appeal the case, there could be a button there to appeal/

or ask the buyer to return the item, send her a return shipping label.

I know Ebay ,many buyers do not read thoroughly, there are so many sellers ,some spent more time describing their sales philosophy,or their life and why they are selling on Ebay, some dont know what they are selling, take poor pictures and many mispell words.

just chalk up to experience, try to get the item back and fight another day.
