Significantly Not As Described return for refund....if buyer pays for return shipping

According to the Paypal process when you file a claim for an item that is significantly not as described, you must return the item at your cost in order for Paypal to issue a refund for the amount you paid, not the return shipping costs. You have 10 days to provide Paypal with a tracking number. Paypal doesn't allow you to post a reply. You send the item back or in 10 days the claim is closed.

 

Buyers are being forced to pay to received goods the seller didn't described accurately, and in some cases, honestly.

 

I think that is wrong.

 

When you can prove that an item is significantly not as described, then Paypal should refund your entire costs of the item including shipping both ways. Sellers can take advantage of Paypal's forcing buyers to pay for return shipping.

 

If a buyer doesn't like something or changes their mind, and wants to return it, then the return shipping should be paid by the buyer.

What about when the issue is that the buyer did not read the auction right? Now wants full refund plus shipping both ways! Who protects the sellers! People get caught up in auctions and only after committing read the description fully! How frustrating to a sell! I have a lady right now who bought an Amish Quilt from me, described as made out of Amish Dress material, she received it and it was  made out of knit material. She was livid! She wanted cotton, I am from the Amish and dress material is 100% knit material, she claims to be an expert. Now she is tying up my item, disputing it for weeks! I offered full money back just not the shipping as it was her over sight. She refused, sellers hands are tied when we do describe item correctly, and we can't leave bad feed back! I have excellent feedback for over 1,600 items, one bad feed back . . . a nutrisystem lunch someone didn't like the flavor of. Go figure! Sellers have it bad too! I hate not being able to warn other sellers about realy bad buyers!

The lady above has not returned my quilt yet and it has been over ten days, is there a paypal rule on this? Or does return come after a resolution?

I purchased a leather jacket from Leather NX in India. When I received the item it did not fit like it was supposed to and also it was a cheap. I returned it to India and they said that they recxeived it. It has been two weeks since from my understanding it should been redelivered to me by now. I have emailed several time but have receuved any any answer. What do or can I do?Please respond. Thanks

Most of my purchases from China have been excellent.  Most of my buys have been excellent but some are just ripoffs.  Clothing seems to be a trouble spot.  Sellers can take a nice photo of a gown, blouse but it can have many flaws that the Seller does not disclose or it doesn't show up in the photo.  Just becaue something exists doesn't mean it's good enough to sell on eBay and some of the clothing my mom bought for a liver transplant patient should have been sold at a yard sale for $1.00 or less.  Then the Shipping and Handling on clothing seems to be generally too high.

Don't file a 'significantly not as described' claim. File a fraud claim.

C'mon - there's a difference between "not as described" and "fraud". 

 

You don't just classify everything into fraud.  Fraud represents a clear effort to rip-off and cheat whereas not-as-described can be subjective interpretation or a failure of an item to perform its functions the way one person expects it should or the difference between "fair" and "beat-up" and other differences that don't necessarily mean the seller was trying to cheat but perhaps didn't check out or evaluate the item as carefully as should have been done.  These types of issues can usually be resolved between the buyer and seller as to either a replacement, discount or refund whereas fraud typically is by a seller who doesn't care at all and hopes to get away with plain old lying about the item.

 

If you accurately describe the problem or issue to a good seller then usually you can work it out and not so likely with a crooked seller.  Although both categories still should result in the seller being responsible for paying the return shipping charges if it involves returning the item back since the buyer shouldn't incur costs for not getting what they expected.

 

You just cause delays in having eBay or PayPal evaluating your claim as different departments handle the different types of claims and if you just continue to claim fraud for every claim you initiate then you run the risk of having your cases decided against you since you then appear to be someone that's just out to rip off sellers yourself.

OK-here is a question and a story-

 

the story-I purchased a leather jacket-ebay auction-received it-opened box-removed jkt from plastic bag-the odor about knocked me over! PURE MILDEW-I like the jkt-I HATE THE MILDEW-

 

I am pretty good solving problems-so I air it out-research safe ways to deodorize a lined leather jkt-then spray the heck out of it inside out with fabreze-air some more-FORGET IT-nothing gets that mildew fungus mold odor out of soft leather-

 

so I have sent the seller my request for refund-mentioned that I feel strongly about being sold a jkt that was obviously UNWEARABLE due to the mildewed state it is in-I am yet to receive a reply-

 

SO-I do not think I should pay return shipping OR the original shipping I already paid-I wish I could have had this jkt-I tried to rectify because I wanted it-I was sold junk-I want the auction win price I paid and the shipping I paid refunded and I do not want to pay to send this smelly jkt back to seller-I was tricked and I am not paying to be tricked

 

The question

What if there is a problem-do I do-what claim do I file?

Sorry had such problems with an International seller.  You should have filed that it was a fraudulent item... which is a different complaint category as opposed to item not as described  and this issue gets a whole different level of attention from eBay and PayPal.  Selling items that are fake is a very serious offense on eBay.  You probably would have had this issue resolved more quickly and thoroughly.  You should be calling PayPal & or eBay  or emailing them at their contact email addresses and explaining that what you received was a fraudulent item.  Good Luck!!

Hello - GLITCHES... please read more carefully - it is the SELLER who posted, not the BUYER.

 

This seller's issue was that the buyer is trying to make an assertion by assumption that the item "zippers" as sold by the seller (the poster above) must not be "vintage" just because the price on the price tags are not in line with what the buyer felt they should be for such vintage items as compared to in a reference catalog although the zippers weren't purchased from the same source catalog's retailer. 

 

As for your saying to the seller (who hasn't posted here) to use "fraud", well, typically that would cross the line from being an attempt to rip someone off by selling a counterfeit, something not even remotely like the item ordered, etc, as opposed to receiving something that is not quite or significantly not as described such as features not working, dead, used instead of new, etc). 

 

In this case, one might consider that either the seller or the buyer has made a grading distinction that may or maynot be based on a ESTABLISHED STANDARD.  If no standards exist other than a general consideration of time such as "anything older than 20 years", etc, then it can be subjective as to whether everyone classifies it as 15 years, 20 years or 25 years, etc. 

 

Also, from the seller's post, he has a buyer trying to get a discount or the item for free by making a flimsy claim about the "vintage" of the item just based on a price tag's pricing so if you were in the seller's shoes and a buyer was trying to pull this on you then what would you do about it and how would you handle it...
