Fraud, Shady seller, scammer, what option do i use to report

Hi all, i need help asap. 5 days ago, i had bought airpods from a seller on vinted using goods&services paypal. i paid 87.55€. about an hour ago, someone on vinted messaged me, asking if the seller is trustable since she wants to buy an expensive item. i asked what it was and she said airpods, just like the one i paid for. since i'm on vacation, me and the seller agreed that he would send it out later when i'm back. he deleted the post/marking it as bought. it was fishy that the other person who messaged me was about to buy it. i asked for screenshots of their convo and when she sent it, i noticed he was rushing her to pay. not to mention - the photos of the airpods were the exact same and he had made a new post, but reserving it to the other person, which is why its not visible on his profile. after a while of talking with that person, we figured he is a scammer. i didn't confront the seller about it, i'm not sure what to say since i don't want to infuriate him, he has my location. i would like to report it to paypal and use buyer protection to get my money back. when i select "report a problem" which of the options should i select? please help.

If you want to open a dispute then the only option at the moment is non receipt of goods.

But then if he decides to send them and provide tracking you would lose.

Then if they arrived and were fake or misdescribed then you would not be able to open a second dispute.

Hey, thank you for replying. I'm 100% sure that he doesn't have two pairs as the pictures are the exact same but he made up different stories why he's selling the airpods. i should also mention that the reason the seller rushed the other buyer to pay was that he apparently had debt to pay a friend AND the buyer demand for the airpods were "high" and he wanted to give her the ability to buy them when the post only got 2 likes/views. I decided to ask to get it shipped to me, he hasn't replied yet. I didn't contact paypal. Another question, you said i wouldn't be able to win a dispute if the item that arrives is fake, but why am i not able to report that to paypal? because when i select "report a problem" it gives me the option to select item does not match description/is damaged. I'm a bit confused.

Did you read my above post? I stated if you opened a dispute for 'non receipt' of item and LOST (if the seller provided tracking) then you would not be able to open a SECOND DISPUTE for 'not as described' if they then arrived and were fake.

 

If you opened a dispute for item not as described NOW then 'if' you won you would have to return the item first before getting a refund, how can you return something you have not received yet?

 

The only dispute you can raise at the moment is non receipt but as I said if you lose that one because the item turns up you can't open a second dispute.

That seems flawed. So you're telling me that a scammer seller can choose to just not ship anything, wait until the victim tries to open a dispute for item not received, then finally ship garbage and get the dispute closed by providing tracking? And now the victim receives the garbage and has no means of re-opening the dispute? Either that isn't how it really works, or scammers have somehow not figured out this scam method through G&S; that's a pretty easy way to get free money.

Well why not read paypals buyer protection policy, see what it does and does not cover and then risk assess your purchases? 

Paypal buyer protection is not a 100% coverall.
