I bought a watch on eBay that turned out to be fake. Ebay system wouldn't let me post a dispute so stupidly went through Paypal I sent PayPal evidence the seller had multiple fake watches for sale and proof they were using pictures of genuine watches on the listings.
Received proof from Longines that the watch is fake, eBay are investigating the seller as they removed 20 listings in one day after the dispute was raised.
Paypals response was pay to return it if you want a refund...
Reported to trading standards, action fraud and the police who have all said under no circumstances return it as it now may be required as evidence. I have told PayPal that I am willing to hand it in at the Police station and receive a receipt but again all they say if their guidelines say it has to be returned.
I was told by trading standards that if they force a return or refuse to refund on an item that is a proven counterfeit then PayPal themselves are then open to legal action.
Again I just get told "our guidelines say..."
So 3 agencies of UK law enforcement have told me not to return it but PayPal say their guidance supersedes that!?!?
Unbelievable!!!
I'm not after a free watch. I've offered to hand it to the police or even destroy it but they just repeat the same thing over and over again!
The seller has broken his PayPal agreement by selling fake goods, yet they want him to get the item back!!
I'm at my wits end trying to sort this out. The FSO have said that if they fail to refund then as it's proven to be fake they may be able to take action under money laundering laws but again the customer service agents just repeat the same thing!!
Can anyway give any advice on what I can do? Apparently I have 5 days to send it back
