If PayPal sides with the other person because you thought you had longer to respond back do they get to keep the item and get there money back ? Or are they supposed to send the item back ?

That depends, if the seller has not responded at all then yes paypal may not require the buyer to return the item first.
Also if the buyer has proved the item is fake or dangerous to send in the post again they may not require a return.
Lastly if its a chargeback and not a paypal dispute then card issuers that make the decisions don't get involved in return of items first.
Advice is voluntary.
