Capture.JPGCapture1.JPGI bought something in Janaury.  It never came.  I decided to demand refund when I file a claim.  I told both seller and PayPal, that i waited too long, don't want item anymore (had to go buy another one from other location)..

Seller didn't refund me, instead, they just reship. it came yesterday and I gave it back to carrier as "refused"

Paypal said case closed because item was delivered.

THAT'S NOT WHAT I ASKED FOR,,, it won't let me reopen case or file appeal to dispute PayPal closure of case.

What can I do?

Refusing delivery, as far as I know, is not a good idea. I think that if it would be allowed, buyers remorse would be very common... PayPal might not allow you to do anything because of that refused delivery. If you funded thr payment via credit card, you can try chargebacking, it's very commonly suggested method if all else fails.

wrote them SEVERAL times that they took too long and demaned refund.  They didn't follow my instruction,,, so why should I accept if they didn't follow my instruction?   Paypal were told same thing...

The way I see it,, if i CLEARLY stated that I want a refund, but they went ahead and ship me the package two weeks later, that's a breach of customer protection on their part.

Now,, According to post office, it is listed as "unclaimed" and it had arrived back to business.

When you make a purchase the seller is only obligated to honor the terms of that sale--the terms which were in place at the time of the purchase.  The seller is not obligated to accept any modification or change in terms or delivery after the make the purchase.

A seller is not obligated to give a refund just because the buyer asks for it.

Where your instructions given before or after you actually paid for the items.  The seller would be obligated to follow instructions given before the purchase, but only if those instructions became part of the purchase terms.
