Filing a dispute for an undelivered website

Hello PP Community,

 

Hoping for a bit of advice here as this will be the first time I've ever disputed through PayPal. Ultimately I'm querying whether we can claim on 'intangible' items like websites? It seems all the talk is on physical items rather than services. I have ample evidence to support my claim and even an email from the seller admitting fault and offering a refund but he keeps going AWOL! 

 

I purchased a website (50% upfront) back in March this year. All the terms were laid out via email (which I still have) stating delivery in 1 month for first revisions. This never happened and he vanished. After chasing him he reappeared with another health issue which delayed things. I accepted this and gave some more time but he vanished again. After about 3 months in, all I had done is chosen a template.  I've given him my logo, my domain and my content and there isn't even a construction page. He has admitted in email that he had health issues and problems with his developer but things are now ok again and he can deliver it in a week, or if thats too late he will offer a full refund of my first installment.  I replied and said how do I get the refund? This was 1 week ago and he's vanished AGAIN and his phone number doesn't work.  I've had enough.  I can document all of this from email trails.    Do I have a case?????      Thanks!
