Claim turned down for computer that won't turn on

I bought a laptop on ebay, the description said no refunds.

It described the laptop as in 100% like new, perfect condition, no issues.

It ran very hot and I wrote to seller twice right after buying it.  

It took two weeks for him to reply after I threatened to go to Paypal. He said just turn it off when not using.

It's been hot all along and now will not turn on. Just black screen. 

When I wrote to seller last week to say the computer won't even turn on now, I got a nasty reply saying it's 9 years old and has no guarantee. And that's why is was $400 not $800. He also said there's no way Ebay or Paypal will refund because he wrote no refunds on the description. I feel ripped off.

Apple says they cannot fix it, the diagnostics showed that it is dead.

Paypal has turned down my claim twice.

I'm stuck with a $400 dead computer. I would appreciate any advice.

Very disappointed in Paypal. I am a longtime PayPal customer. I am thinking not to use Paypal any more.

I think in such cases it is difficult to receive enough proof of the situation. PayPal also does not offer warranty so if it has worked for some time (altough fans apparently running high) then I think you can't really do anything. If it happens to be Macbook Pro from 2007 with Nvidia 8600 graphics card then those are very well known to have overheating and graphics card problems, Apple introduced repair extension program for those back then but of course it is no longer valid. Also I think that 400USD is way too much for 2007 MBP so unfortunately I think that was bad deal for you even if the laptop would work, now it is of course horrible. It also not uncommon for some people to "fix" failed graphics cards (solder contacts to be exact) with unprofessional ways and then sell them, because used stuff doesn't have warranty it is enough that it lasts for some time, as those "fixes" usually do.

$400 seems like a lot of money to spend for a used laptop on eBay, especially when the buyer offers no guarantees.  This is a 9-year old computer, likely near the end of it's life expectancy.  Buyer accepts the risk.

 

 

Neither buyer nor sellers will be able to provide accurate and proveable data to support claim.  PayPall will make a decision based on the merits of the claim, but without being able to verify anything.

 

If if buyer wins, buyer will need to pay for tracking shipping to seller before a refund which will not include return shipping.

why do you go to Paypal?

You should have filed Item not as described on Ebay ,and get Ebay involved,your seller if he refused to send you a shipping label t o return the item,then escalate to get Ebay involved,Ebay should refund you in full,since item is not as described and he does not accept return,in EBay jargon,he does not want it back,so you get the keep the item and your money.

 

these disputes of item not as described happen every day on Ebay and it is quite potent,if seller accepts return,he will send you a return label,if he is a top rated plus seller,return policy is 30 days and he pays return shipping.

if seller said no return,then you get to keep the item plus your money.

you dont even need to prove it is not as described,your word is enough
