we have a contract between us
how can I save both of our rights so that if he didn't follow the contract agreement I will get a refund

Welcome! Thank you for visiting PayPal's Community Forum. I can certainly understand why you'd like to preserve the contract agreement in case anything goes differently than expected. Normally, PayPal's Buyer Protection is what you would want to reference if a problem came up. Our dispute and claims teams wouldn't usually reference a contractual agreement beyond PayPal's own Purchase Protection and Seller protection.
