Refund for item not received from ebay after their 45 day resolution period

I bought tickets from a seller on EBAY on behalf of my boyfried for his brothers Christmas present.  We paid £214 and the seller then advised he didn't have the tickets yet and forwarded an email showing the Ticketmaster purchase.  He promised to send the tickets upon receipt of same.  I sent a few emails chasing this and he always responded quickly and said they'd not arrived yet but as soon as they do he'd send them. Unfortunately, my grandad passed away and I had to travel to England for a while to be with him and then help with funeral arrangements. When I got back I emailed the seller again and haven't received a reply.  The 45 day period with EBAY has now expired and the seller isn't responding to any of my emails.  What can I do?

I'm going to be the bearer of bad news I'm afraid. Once the 45 days has passed we are not able to act on your behalf. I know there are circumstances for the 45 days going by with the sad passing of your Grandad but we are still unable to act.

It is necessary for us to cap the timeframe for opening a buyer complaint. We have found that in most cases 45 days is a sufficient timeframe for a buyer to notify PayPal that they have not received their item, or that there is a problem with the item that they have received.

Additionally we are required to specify a set timeframe in our legal agreements. This lets sellers know that they should keep their postal information and other relevant transaction details for this period. It also reassures buyers that should something happen with their purchase within a 45 day period, they can open a complaint with PayPal.

I know it is not the answer you were looking for but outside 45 days we can't act.

Sellers shouldnt be able to sell tickets and accept payment through paypal then if the tickets arent due to be dispatched until after the 45 day period otherwise you have no assistance if you are the victim of some scammer who just wants your money.

I would still hold some hope for you.

Most tickets for events are not sent to the buyer (Original) until there is 2 weeks until the actual show date.

I have brought tickets to see lee evans and the box office have advised me that I will not receive them until 2 weeks before the show. 

Maybe your seller has been busy but if his feedback is great and he has been replying I think you will receive them.
