Buyer Opens a Chargeback Case and mocks about it

I have been victim of a fraud, and I am the seller, which is very, very frustating, I am PayPal Advantage member, but I dont see any "advantage here", this is what happened.

1) A regular customer contact me and ask for a phone
2) Everything was a expected, payment done, shipping done, delivered confirmed, everything as usual
3) Yesterday, 29 days later AFTER phone delivered, I receive a chargeback case, reason 1, (which by the way, I dont know that the "1" means)
4) I contact buyer, he replies mocking about the situation.

However, I understand that I can not use an email as a solid proof, but I tell you here I am telling the truth, I have provided paypal, with all the information I have, but this is very frustating.

Its very clear that customer wants a free cellphone, as a Seller this is a loose-loose situation, the customer has nothing to loose, if he gets his money, cellphone for free, if he does not, anyway, he got a phone.

I dont know what else to do, or who should I contact, as far as I read, a "chargeback" is card bank and not PayPal decission, so!, where is "sellers protection"?

Hope somebody could help with some ideas, Thanks in advance.

I totally understand what you are going through. I am going through a similar fraudulent charge. I have been a member of EBAY & PAYPAL for well over a decade with 100% feedback I too am an Advantage member and so far I am the one being penalized and there is no benefit from EBAY or PAYPAL Advantage. And  If PAYPAL ends up siding with the buyer I will never do business with PAYPAL or EBAY again. Period. We, as sellers barely have any rights.

Hi,

I am curious about your case. Did you find any solution? I have a similar case.

Sold item, shipped, proof of delivery.

Buyer filled a unauthorized purchase and paypal sent me a message saying that the credit card company decided that the buyer is right.

Did you contact a lawyer?

HI, you guys are so right. there is no solution for the seller. They just took 400.00 from my account at midnite  for a claim that someone who claimed he received an item not as described. He received the item back in December. He never returned the item. They claim they "are in the trenches fighting for you" BS. I was told that the buyers credit card company file the complaint and they don't "believe" they can fight the dispute. They also charged me 20.00 for the handling of the case. I cannot believe they would allow a buyer to keep an item and give a refund. They explained that I should contact the buyer and ask for my item to be returned. What kind of crap is that.  Last time I felt like this was when my home was broken into. Sick to my stomach.

Good luck with your issue.

Paypal thanks for helping me re-live some bad memories.

Hello everyone.

I'm sorry to hear about the problems that you're experiencing with your buyers.  Chargebacks are always a difficult situation because PayPal doesn't decide the outcome.  In most cases we'll dispute it for you with whatever information you can provide (there are some instances where we can't or won't be able to), but when it comes down to it, despite our best efforts, the credit card company will make whatever decision they feel is appropriate and we can't change that decision. 😞

At the end of it all, if the case goes against you, your only option at that point would be to contact either law enforcement or legal council. While we would love for there to be an other option through us, once that credit card determination is made, it's been taken out of our hands.
