Hello,
I'm here to get sone information on a dispute that I currently have ongoing. To keep it short, I received a PayPal Gift, the sender then disputed it as an unauthorized payment under the category that I as a seller did not send the item, however this transaction had nothing to do with the sale or purchase of any item or goods of any kind, was simply a gift received as explained.
Upon investigation of this, the reply I got was;
We have completed our investigation of the transaction below and were
unable to find evidence of unauthorised access to the buyer’s account. This
case was refused to the buyer and no funds were recovered from your account.
At this point I would have thought the issue was taken care of. However at a later date I received this e-mail;
We were recently notified that one of your senders filed a chargeback. This
simply means they asked their credit card issuer to reverse a payment made
to you purchased on 30 Nov 2011.
The sender claims that this purchase was made without their authorisation
to use the credit card. Their credit card company needs additional
information from you about this transaction to help resolve this.
I once again provided the same information as before to PayPal, insisting that the police should be involved should the person in question wish to pursue this further - It's obvious I've been the target and victim of a malicious attack which has left me out of pocket and having to pay a fine on top of this, this seems downright unfair to me and I'd appreciate some help on the matter. I will certainly be contacting my solicitor to look into this as it would appear the law would be on my side given a police investigation would find no evidence of malcontent in the transaction.
I'd like to note that my Paypal stats on this claim reads:
Paypal status: Status: Disputing on Your Behalf
However the line below this is a complete contradiction and has left me unclear of the actual outcome:
Status Details: We have reviewed the case. Because you have not met Seller Protection performance requirements, the transaction will be reversed. The case is now closed.
Should a PayPal official read this, the case ID in which I refer to is PP-001-596-939-176

Good luck. I have the same issue and Paypal doesn't seem to care. My chargeback is listed with the same statuses, even though the buyer has cancelled the chargeback with Paypal and their CC company. Paypal is saying IF I win, it will be 75-90 days before I get my money back. The buyer left me positive feedback and has even offered to help, but that doesn't speed up Paypal.
If your claim is legitimate, I would contact the police department in the buyers city and file a theft charge against them.

Thanks for your reply, sounds like you're in a similar situation to myself. I wrote a very detailed letter to Paypal and got a similar response to you - They told me it's ultimately the decision of the persons credit card company and that they have no influence. I'm pretty sure that when Paypal disputes it with them and the description is along the lines of "No proof of sales shipment" that in turn could influence their decision just due the limitations on Paypals behalf.
I'm not really sure what I could do to further help my case, I have insisted that the police be involved but not sure how I can enforce that myself; the situation is rather silly and in no way could the credit card company possibly prove that it was unauthorized and the only way I can imagine it happening is to simply keep their customer happy.
All in all a lot of trouble and really puts me off using any kind of online banking again in the future.
If anyone has any advice that'd be great.
