Paypal Unavailable while Dispute Open ?

Hi,

 

Yesterday a dispute was opened against me through Paypal.  An Ebay seller from Hong Kong sent me a phone I didn't want, rather than refunding me, in Oct 2012. I requested a refund for the phone after getting 2 faulty phones from him and he wouldn't refund, only replace or repair.

 

  I got the £160 back from him using Visa Chargeback through my bank around the same time.  I refused to use my own money to send this phone back and it took him 3 months to send me £10 to cover the UK to HK return postage.  I explained to him that Surface Mail takes up to 56 days possibly and the item is not tracked at all.  I have kept all my emails from me to him regarding this.

 

He opened the dispute a month after sending the phone back, and since yesterday then I haven't been able to pay for Ebay items like the Yamaha amplifier that I won this morning.  I imagine the seller won't be too impressed about that.   

 

My Paypal a/c balance reads 14p negative balance as I'd sold an item the night before and my seller paid me straight away £7.50 for item and £2.20 P + P.

 

My main concern is not being able to pay for items I've won, but secondly there's no place to copy and paste the proof of postage if I escalate the case to Paypal

I thought as much. Thanks for confirming. I will email the proof of postage to the HK seller tonight.

I escalated the case to Paypal. Sent loads of emails and proof of postage as evidence. I got a message 3 hours saying due to the unique circumstances of the claim, PayPal will refund him his £10. The status of the closed case reads 'After careful consideration, we're unable to decide this claim in your favour at this time.' Does that mean they didn't find in the Hong to Kong guy's favour as he opened the dispute originally or didn't find in my favour? HK guy has no reason to receive a refund in my opinion. It's really annoyed me and even though I'm not directly refunding him from my bank account, the £10 obviously comes from PayPal users money. That little fee that PayPal takes whenever you get paid by someone.
