Unresolved Dispute!

In 2008 I made a purchase and never received the item. I tried to contact the seller several times by email, with no results, so I opened a dispute about my purchase. I tried several times to get my money back by contacting the seller and PayPal. The claim I opened was closed and never resolved. All I got was three emails from PayPal that my dispute would close by a certain date. Nothing more. To this day I am out of my money and have never heard from the seller and PayPal. Here is the email PayPal sent to open my dispute. The first of three. Nothing more. The seller never contacted me. There was never a resolution.

Hi Aaron47,

 

Welcome to the forums! I'm sorry to hear you lost your money in that claim in 2009. What happened, exactly? Did the dispute ever get escalated to a complaint or did it time out for lack of response?

 

In the email that you posted, it says that you had until February 19, 2009 to escalate the dispute to a complaint by logging in and going to the Resolution Center. If you did that, then the seller would have been prompted to provide tracking and you would have won your money back if they failed to do so... but PayPal needs to know from you that the item is still not received before the deadline is up, or the assumption is made that everything has been resolved, and the dispute times out. To keep the process going, the buyer has to go to the Resolution Center and escalate the case, as described in the email. The subsequent emails were reminders of the coming deadline, to let you know that your action was needed.

 

I'm sorry that the instructions were misunderstood. It sounds like you probably would have won. 😞

I did escalate the dispute claim, but never heard anything more from PayPal and never ever heard from the seller. I sent an email to PayPal complaining about the lack of anything happening and still got no reply except the email about the timing out. During the whole process I was the only one doing anything. All PayPal did was send me emails about time limits. Nothing more.

PayPal has proven to be a good service most of the time. Except for this one case where I got scamed. I still use PayPal and will continue to do so unless another occurrence like this should happen again.

pleasr remove the strike you have against me, i was having trouble with paypal.the issues have been resolved with them but my accout is susspended due to the strikes i have. please help me with this. barbara revells

In dec.2010 i made a purchase of 2 items from canal boat and i have yet to receive either item.  I filed a dispute with ebay and  i contacted seller numerous times for both orders and i got a response that mail was delayed for bad weather, that i was to wait and i would get package. Yea, right.  I eventually filed a claim with pay pal and was given a refund for 1 of the items and nothing fot the other and paypal closed the claim saying that because i got refund for 1 item that the claim had been resolved.  No way, so far 2 items from 1 seller and 1 item from another seller in 1 week that i have never received and only a refund for the item purchased after the original, the seller contacted me and said they would re ship but have never done it, nor was there a way to track orders, paypal closed case...................I thought buyers were safe using paypal, my money from 3 orders was easily taken by sellers that never delivered how safe is that...I think any shippment from any place should have a tracking code and buyers should be able to track.

hi this is news for me as i have just had a simular thing happen to me i bought a phone from ebay paid through payapl with a bank payment on the 29th january on the 3oth i had and email from ebay saying the seller had all there listings removed from ebay and when i looked they were no longer a registured user. the email also said to contact my bank which i did and opened a disspute with ebay as they had said i should.

my bank mangaed to revoke the payment to paypal who had already sent the payment to the seller

ebay said i had to wait ten days to seculate my claim but as my bank had revoked payment as far as they were concerned i had got my money back so the case for them was closed.

 

paypal on the other hand had given me a negative balance and tried to again get money from my bank who had again refused they also have said i need to resolve my negative balance and seem not to be able to recaim the money from the seller i have today been on the pone to ebay who have basicaly washed there hands of the case and have said its my banks fault tehy should of not interfeared but it was ebay who said to go to them.

it seems i ahve now lost quite a few years of good history with both payapl and ebay and feel i can no longer use either of them but payal are stopping me from removing any cards and bank accounts until it seems i pay them for a phone i never had or ever will and the seller has won can this be fair how can i get out of this situation as ebay and paypal dont seem to wnat to help

you know it seems to me that these two highly respected businesses would take care of there dedicated buyers, the ones that spend money and has invested time, money and are truley honest rather than these sellers that take money and then close their accounts.  It is our money that is being stolen and they are suppose to take care of the situation.  It is a wonder that these businesses are still doing well.  Thousands of people use them daily and if a small percentage lose money a day they have made lots for their pockets.  I hope everything works for you, tell your bank the situation and they might issue you another card and close out that one paypal has a hold on...LIBBIEGIRL1

libbiegirl1 - If the decision wasn't applied evenly across both cases, you should contact Customer Solutions and ask them to review the situation. I'm sure they can get to the bottom of why one went in your favor and one did not.

malenurse911 - It sounds to me like you filed a claim through PayPal and then also had your bank claim against the payment as well. That's a frustrating situation because it closes out the Buyer Dispute, and then a different process applies. Is there another case in your Resolution Center? There may not be, depending on the circumstances, but if there is, it may provide more information about the status of the situation.
