Scammed and Paypal won't refund

I ordered a fitbit versa 2 on a one-day sale at what appeared to be the fitbit site. I paid, idiot me, with paypal. Utter silence ensued: no response, no receipt, no nothing. I tried to find the website again--nothing was there, and there was no paypal button on the real versa site. I wrote an email to the address filed with paypal--no response. I received, obviously, no watch.

 

I filed a claim with paypal, which received from the seller a fake tracking number that showed the package delivered. It was delivered, ostensibly, by UPS Ground, weighed five pounds, and was delivered two days after shipping. Which seems unlikely for a watch and for UPS ground, but Paypal was convinced. 

 

Other customers of paypal have had the same problem with a fake site selling Dewalt tools. The scammers furnish paypal with a tracking number saying the package was delivered. Paypal says, wow, thanks for that ironclad evidence that UPS Ground delivered a five-pound watch in two days. 

 

I am out a lot of money, and I will not use paypal again if I can avoid it.

Yep loads of these scams from folks that have bought tat from China websites or from Facebook.

 

To submit an appeal on the dispute that was closed, PayPal asks that you obtain a detailed report from the shipper (on their letterhead or some other form of official stationary) that includes the address the seller gave them for the shipment or that includes a statement mentioning your address and saying the item was delivered to a different address.

 

When you have that, contact PayPal via phone (log on to your account and click Contact at the bottom of the page), via Facebook (send a Private Message to PayPal) or via Twitter (send a Direct Message to @AskPayPal) and say you want to appeal the denial of the dispute based on the shipper saying the item was delivered to a different address. Once it's submitted (you will be provided with directions on how to do that), the dispute will be reviewed further and a determination will be made.

I saw this post come up in a search because I was recently scammed the same way. I purchase a rolling tool chest from a Chinese seller on Facebook Marketplace, only to realize it was a fraud a couple days later, when I received a notice the shipment was out for delivery via UPS but the package said it was only 1.3lbs. This thing was advertised on the web page as weighing FAR more than that! When I checked the provided tracking number? It said it was delivered a couple days earlier to my house address! Thing is - it was a valid tracking number from another item I’d ordered recently. So guessing they somehow managed to steal that info out of my browser cookies! PayPal won’t refund me because the tracking number shows a delivery and to my proper address. What now??

Same happened to me! They’ll refund you for an item that wasn’t as described, but not for an item you didn’t receive. Want you to contact seller yet can’t or don’t respond. Makes no sense!

Same issue. Ordered a graphics card off Bonanza.com that was a new seller but seemed legit and figured, "hey. I can pay with PayPal, threw my credit card, and I'll be protected if something is wrong". Seller was all over with shipping, randomly got an email it was shipped via next day air late on Sunday night, from the US and not UK, was expected Monday, and weight was .70lbs which the card should have been at least 4-5lbs. Tracking was provided ups and it just updated randomly to delivered, I was home, have a door cam, and nothing came. Sent paypal messages between myself and the seller with my expressed concerns it was a scam even before it shipped. They don't care, denied my claim and I'm out $625. Hopefully my credit card company will do right by me and refund it as I disputed the charge with them as well. Otherwise I guess I'll have to try and get something out of ups. Sad I won't be using paypal anymore after this because I definitely don't feel like there is any good buyer protection if this is how easily you can be had even using "secure" and "buyer protection " platforms of payment.

Paypal is just a payment processor that gives you 'some' buyer and 'some' seller protection.
So disputes for non receipt of item are mostly automated. Seller provides tracking that shows delivery = seller wins.
So then its your turn to do some work to assist Paypal in recovering your purchase price from your seller.

Firstly ring Paypal customer services and tell them that the number is fake or that the item was shown as shipped before you purchased it. With that information they may well just issue you a refund.

Secondly if they don't then... APPEAL
To submit an appeal on the dispute that was closed, PayPal asks that you obtain a detailed report from the shipper/courier (on their letterhead or some other form of official stationary) that includes the address the seller gave them for the shipment. Or one that includes a statement mentioning your address and saying the item was delivered to a different address. THEY DON'T HAVE TO SAY WHICH ADDRESS IT WAS SENT TO, JUST THAT IT WAS NOT DELIVERED TO YOUR ADDRESS.

You also have the option to contact your card issuer if you funded your Paypal payment that way and see if they will do a chargeback for you?
