Appealing a Dispute Decision

I purchased two boxes of surgical masks for my wife who is a healthcare provider. Once I knew the item is being shipped from China, due to extended delivery time, I tried to cancel the order but the seller was not responding, so I opened a dispute case few hours after the order to cancel the shipment and recover my money. PayPal gave a chance to the seller to respond. The seller seeing my desire to cancel went ahead and shipped the mail. The mail arrived, it was a tiny envelope with the same tracking info the seller added under the dispute. Instead of two boxes of surgical masks, the mail included 1 fidget spinner toy in metal rusted box. After opening the mail I escalated the case and included the detailed description of the scam. To my surprise, PayPal closed the case today in favor of the seller just because the tracking shows the item was delivered to me, ignoring the fact that the seller shipped an old toy instead of facemasks. How this can be fixed? Resolved by PayPal

My situation is very similar.  I purchased a Garden Kneeler and bonus bag for tools.  I received the bag but not the Garden Kneeler.  I contacted the Seller and sent me an email stating I only purchased one set.   I wrote back that I did not get the whole (1) set.  Only the bag.  They wrote back that I only purchased the bag.   I have photos of the product showing the bag as a bonus.  My receipt on PayPal shows Garden Kneeler and Bag was purchased.  I file a complaint with PayPal and they denied it because the Seller showed they had mailed it and it was delivered.   I tried to appeal but there is no place to do that.  I have copies of emails, photos of product purchased, product received with package it came in that shows it could not have held the Kneeler.  I am very disappointed with PayPal,  I told both Seller and PayPal that originally I just wanted the rest of my purchase, The Garden Kneeler, but since the seller denied me I wanted my money back.   Now I don't know if I will ever use PayPal again for "safe" transactions.   Buyer beware.

I dealt with same seller. I finally got refund by posting horrible review on Amazon. They contacted me to remove it and I said I would as soon as refund came thru. Good luck.

I have a similar issue and PayPal denied my claim as well.  The link to appeal the claim is not working, and there's no way I can get through on the phone.  The automated system just goes around in circles.   I ordered 3 jigsaw puzzles for a total of $91.80. When I received them, they were not what I ordered, and are very offensive to me.  The seller's website had a very clear refund policy, so I contacted the seller.  Turns out, although the items were sent from Los Angeles, the seller is in China.  They offered a 10% refund, unless I returned the puzzles - to China - at my cost, which is more than $27.  After going back and forth with the seller, they finally offered a 24% refund, if I returned the puzzles.  Still not acceptable, so I filed the dispute with PayPal.  Seller provided PayPal with the tracking number, showing the package had been delivered, so PayPal closed the case, in the seller's favor.  I'm out $91 for nothing, and no way to appeal PayPal's decision.  Very disappointed with PayPal.

Same here. I fell a victim to a scammer from China that promised an amazing toy dog that looks and behaves like a real dog, and even published a video of the "product" showing an real-life dog toy. What I got was a miserable toy that you can get for $3 in any farmers market. The seller/scammer agreed to refund 10%, then 20%, then 50%. I refused and opened a dispute, escalated to PayPal and eventually the seller/scammer agreed to refund 100% if I return the junk to China at my own expense, and they said that they would deduct processing, restocking and other fees. I would be left with maybe $10 back.

And where is PayPal's buyer's protection? Gone... Watch out, when you really need PayPal's protection, good luck, you're on your own.

Just for future notice when shady scammers ask you to mail back an item to China or Philippines. They are certin it going to take up most of your refund. It is part of thier pre mediated scam. This is one of the benefits of Paypal that gives me one up on these kind of sellers. Make sure to activate you buyer return shipping fees before placings another order online. Paypal will refund your return shipping charges up to $30 per transactions. I believe this service can be used 10 times per year. Yes, even for international returns. Keep in mind also... lets say your shipping charges exceeds the maximum $30. For example you return shipping coast $44.00 This does not mean your out of luck. Paypal will still kick in the maximum $30 so you just be out of pocket the remanding amount of $14. So when the seller starts trying to negotiate explaining how they are doing me/you a favor explaining how they are just trying to save me money. I am politely nice just asking them to please just stick strictly to thier own refund policy that clearly states the buyer pays the return shipping and refunds will be issued. They usually just refund the item after that and do not even want thier own junk item back. Very Ammusing.....

I have now had 3 claims rejected because the vendor stated that the items had been delivered. But nothing has arrived at my address. What can I do?

Same. PayPal ruled my dispute in favour of the seller who sent a fake tracking number. I contacted the local courier who confirmed the parcel was sent to a different address than mine and not in my name. The scam website has bad info on a tracking site and surprise surprise it has shut down after the dispute. I sent PayPal a message about the fake tracking they never replied, closed the conversation and the next day ruled in the seller's favour. Very disappointed, I've bought thousands of dollars worth of items through paypal so why would I try to dispute an $80 transaction!

Update: I messaged PayPal with more info and they reopened the dispute and voted in my favour! I'm very pleased with the outcome.
