Obviosuly scammed and Paypal failing to uphold seller protection

Heres the short version;

 

Sold a couple car parts on ebay in early Feb, dude paid for it and I shipped them to him via Fedex with a tracking number to his verified address. A week or so later after delivery, he opens dispute claiming he didn't authorize the transaction. His bank/credit card company then ended up winning the case somehow even though I uploaded the same tracking number I did on ebay showing it was delivered to his house! So i called paypal on march 6th and the lady basically said I'm SOL even though I did everything correct and the transaction shows "Eligible" for seller protection on the transaction. She said Paypal was going to dispute the charge back from the credit card company and I had to wait. I'm now speaking to Paypal again and they seem to have no idea about a dispute against said credit card company and still no help or fulfillment of this so called Seller Protection that I pay my Paypal fees for on every transaction.

 

I'm beyond **bleep** off as this is false advertisment and poor business practice. I want my money back that I rightfully own. I pay my fees and do it all correct. So why am I getting **bleep** out of my money?!

PayPal does not decide who wins in chargebacks cases. The card issuer does and if they determine that the transaction was unauthorized then the card issues buyer credit back and PayPal has to return the money to pay the card issuer back.  We are sub-accounts under PayPal's merchant account so when buyer files chargeback, it is against PayPal and PayPal holds us liable.

 

What I don't get as well is why PayPal seller protection program won't cover you since your payment was eligible, you had tracking saying delivered or proof of shipment, a physical item purchase, and chargeback reason is for unauthorized transaction.  

 

Was the amount in question of high value?  

 

On the other hand, it does say in user agreement that PayPal seller protection "may" apply or "you may be covered" so it's no guarantee.  That said, I recommend you keep trying to get a rep or speak to a dispute specialist that will "get it" and help you.  Persistence is key.

If her items are partially or fully eligible for seller protection and it sounds like they should be,for unauthorised transaction dispute,all she has to do is  to show it has been shipped to the address on the payment notice,it does not even have to be delivered or signed for.

In her case,she shipped Fed Exp,unless it is a different address than on the ebay/paypal notice,then she should get Paypal seller protection,Paypal would have to eat the loss.

Paypal customer service is getting worse and worse,you would have to remind them of their policy,ask to speak to some one who has been around

The amount is 265 dollars, shipped to the verified shipping address and shows delivered. Whay paypal just told me this last call was that their "protection" is them acting as my lawyer and disputing the claim to the CC company of the buyer. I told the lady over and over, reading from the seller protection policy page that I am to be protected against "unauthorized charge back claims" and that I should get my funds back and paypal can fight for THEIR money back. This "protection" policy is a joke and paying paypal fees is also a joke if this is what I get for "protection". She said the CC company has up to like 80 days or something to make a decision and that I'll know sometime early May. I asked if the case is still sided with the buyer then what, I'm out my money? And all she could regurgitate is about how paypal will back me for the dispute for the CC company. I'm so frustrated and angry it's not even funny. I wish I could email/speak to someone higher up or put this situation out in the open for everyone to see how shady paypal is. I feel like a classaction lawsuit is possible if I lose this dispute because I'm SURE many others are dealing with the same sort of thing. If it's that easy to buy stuff on ebay, pay with paypal then charge back on the CC, whats to stop everyone from doing it?

Is the funds still on hold or was it already refunded?  

 

The user agreement used to be more detailed about this stuff but now the wording is "may" this, "may" that and vague.

 

Will just have to wait until the card issuer's decision and at that point PayPal can check your standing and refund you according to their policy win or lose.  PayPal policy makes no mention of a procedure when they will refund coverage of chargebacks but only that they will, if eligible.

 

If the dispute resolution is blatantly abused, credit card companies and PayPal will put a stop to it.  They investigate the disputes.  

 

I CB'd a purchase once, didn't hear from the merchant so I filed chargeback.  My card credited me.  Then weeks later, I finally got a response and a another refund was issued to my card, then a couple weeks later my card withdrew the initial credit.  These things take time for them to sort out.  I didn't call in after the initial chargeback.  I was just a spectator and watched as things just kinda took care of themselves.  

 

Should PayPal notify you formally that they decided not to cover you after the card issuer makes the final decision, then kick up a fuss.  File with complaint with BBB.org

The initial claim was opened in Feb and closed early march. Paypal wanted info on the deal, so i uploaded the tracking number thinking I'd be set. The case was closed and sided with the buyer. It blew my mind. Thats when I got on the phone on march 6th and was like WTF. All I can do is wait since paypal isn't providing any sort of actual monetary protection and having already taken the money from my account.

 

It's funny when you read the actual policy paypal has on their site

 

"The complaints described above may reduce your PayPal balance. But with Seller Protection, provided that the transactions meet our requirements, PayPal will protect you by keeping your balance intact – meaning you get to keep your money and won't be required to pay any fees."

 

Yet i lost my money, and i met all the requirements. Makes total sense. Would love for paypal to comment on here and fix this...

NOT SURE An appeal of a credit card chargeback case works the same way as a Paypal dispute.

Paypal submitted information to the cc issuer and they decide.

But she should pursue Paypal/Ebay seller protection.

Didn't mean an appeal to CC (I know quite well that the seller has no standing there) but and appeal to PP for being denied seller protection to get reimbursed.

you were talking to a low level customer service clerk,Paypal and Ebay have become rather complex with so many rules and so many scenarios,it is difficult for them to deal with,every phone call is a situation they have t o reach t o the back of the mind what rules,what country,what venue?

They dont want to give you promise or raise your hope too high,as they are not high level enough to speak for Paypal  .

if you lose the chargeback and Paypal would not cover y ou,call Ebay,your $20 chargeback fee should be picked up by one of them.

BTW,both Paypal and Ebay have ways of finding out if an unauthorised transaction claim is true or not,not always,but sometimes they do?
