Escalated to Dispute to Payal claim but forgot to put partial refund

Hi I recently purchased a laptop wherein one of its parts aren't working. (Video Card)

 

seller refused to give me a refund so I decided to escalate the dispute into a paypal claim. I immediately escalated it and I forgot to include in the Paypal claim that i want a partial refund.

 

My concern is that if I win the Paypal claim, am I required to ship back the laptop? I want to keep it. I just want a partial refund that will be enough for me to replace the broken part.

As far as I know, you are required to ship the item back. Partial refund is something that seller might agree and if so, then the case would be closed. Again, as far as I know, PayPal does not make decisions which involve partial refund.

Thanks for the quick reply. Does that mean even if lets say I escalated my paypal dispute to a claim and I was able to place my desired partial refund amount  in one of the options there, it's still up to the seller to agree and if he doesn't,  then my only option is to ship back the item and I'll be getting a full refund?

Yes, I think it will go that way, if seller agrees with you then it ends there, but if not then PayPal cannot decide any kinds of sums which would be correct so they'll only advise you to ship the item back so you would get full refund and the whole deal would be "cancelled".

 

I think you would need some kind of report from qualified technician or something to even have a slightest (still nonexistant I believe) change of PayPal agreeing with you that spesific sum should be refunded.

Even if you do ship it back you may be adding even more risk as there could be real damage or just an appeal that it wasnt the same item.  Once you get PayPal involved for a computer return you're leaving the solution out of your control and you could have a greater loss.

For the seller the risk also increases when a third party is forced to intervene inthe solution.

 

You are much better negotiating a solution with the seller outside of PayPal.  PayPal doesn't like disputes on buyer and seller risks and the raises their overal risk level.

 

This is where it is vitally important to purchase only from reputable business.  Even then, the art of nogation is important.  Most buyers and sellers don't understand this and want to allow PayPal to intervene.

 

For your specific case, was it a brand name new computer?  What were the specifications about the computer?  Was this is a re-sale or purchase from a computer dealer? Was it a domestic or international purchase?

 

If it was purchased because of a low price then you should realize higher risk.

 

Did did seller offer any return policies before purchase?

Once the case is escalated to PAYPAL review,neither party can add anything new t o the case,Paypal willprobably ask you to return the item and get your refund.

If you do not want to do this,then negotiate with seller outside the case for a partial refund,you know you have to pay return shipping and he lost on original shipping.

so better settle for a partial refund,you keep the item and he keeps some of your money.
