Returned faulty wrong items but no refund!

Hi,

 

This has been a complicated issue and started in October when i paid £400 for some new pistons. they arrived in bad shape and were missing important parts (rings and pins) but to make things worse they were completely the wrong size and not even for my car.

 

For months they promised to get the correct ones and repeatedly told me they were on order and were being quality checked and would be here in a few weeks and this went on for months untill they finall admitted they could not get them!! they told me to go and buy from somewhere else and they would pay the difference.

 

I bought some from the states and the total with shipping and import duty was £640 i supplied all the invoices and receipts and returned the old pistons back to them signed for! and they have just ignored all emails and phone messages now for over a month.

 

I at least want the original £400 backthat i paid via paypal to this seller.

 

They are an ebay trader but this sale was through an internet car forum which he was a trader on.

I have all the documents to prove payment and return of the product.

 

Is there anything i can do and will paypal be able to do anything in this case?

You only have up to 45 days to file a paypal claim which you should have done before you sent the item back trackable to prove delivery back to the seller.

 

However if they are a business then they should have their business details on their ebay auction.

 

Then contact trading standards which will give you gr8 advice on how to get your dosh back under distance selling laws.

 

If they are not a business you can still pursue a claim in the small claims court again consult trading standards.

 

Often when the seller knows you are going to pursue it they refund.
