What happens after I file a dispute with PayPal?

I purchased a vacuum cleaner from a seller on Ebay, who seems to have a fairly decent rating (although many comments included "slow to respond" or "slow to ship").  The purchase was made on June 15th and I paid the seller the same day.  I had two communications with the seller through Ebay: one was him saying he was behind in shipping items out because there had been a tornado in his area (this was around June 26th) and another was around the 1st or 2nd of July, with him saying the vacuum would be shipped that week.  After 3 weeks of excuses, I escaladed this to a dispute wtih PayPal, as I still hadn't received shipment confirmation.  Now the seller refuses to answer my messages in Ebay and hasn't responded to my dispute in PayPal (his response is due tomorrow, July 14th, per PayPal).  What happens if this guy never responds to the dispute? Is he legally obligated to ship me the item, since he sold me this vacuum on Ebay (real auction)? I've purchased things on Ebay numerous times and this is the first issue I've had with a seller.

 

Any advice would be appreciated!

If he doesn't respond, he loses.

 

See if you can escalate the dispute to a claim at this point.

And if he loses...what does that mean to me? I just get my money back and no vacuum? Or is he obligated to still ship the vacuum?

Yes, you just get your money back.

 

Nobody can force a seller to send the item to you.
