I have been paid money for a deposit which I now think could be fraudulent I have contacted the buyer to ask them to either confirm or withdraw payment but no reply. PayPal say I can’t set up dispute please help what can I do?

You can issue a refund BUT if the funds are on hold then the refund would come from your bank account and then you would be paid back when the hold lifts BUT you would not get the fee you were charged when the buyer paid returned as part of that refund so the fee amount would come from your bank account.
The buyer can't withdraw the payment as it would be showing as complete on their side, they can only open a dispute for non receipt of item OR item received but not as described. Any held funds are between you and paypal.
Advice is voluntary.
