I purchased an item from a seller in Florida and paid for it on Dec. 1. Listing said that item would be shipped 2 -3 days after receiving payment. I attempted to receive a date which the item was shipped. Did not receive it until Dec. 19. Of course I panicked and purchased the exact item from another Ebay seller and received it in a timely manner. Question is, it is due to arrive Dec. 30....I obviously do not need it as Christmas is over and has been replaced. Should I accept this item IF it shows and return it or what do I do????????

I don't blame you one bit for panicking. I have children too, and I would probably do the same thing in your situation. Those little smiles on the holiday are worth so much!

Hrm. Well, that's certainly not good then.
If you haven't already contacted the seller, I would do so and work with them to cancel the sale. If it was purchased on eBay, you may be able to work with the seller to have the auction withdrawn so that they can receive a fee waiver from eBay.
If you have already contacted the seller and still don't have the item, or they're non-responsive, you may consider filing a dispute for Non-Receipt. If you do so, state in the note that you haven't yet received the item, have since purchased a replacement, and request a refund from the merchant. This should get you moving towards resolution and a refund.

The moderation staff can't comment on account specifics, so I wouldn't be able to let you know why your merchant hasn't yet sent the item. If you haven't yet contacted the merchant, I would recommend doing so. If the merchant isn't responsive to your requests, just make sure you file a claim for Non-Receipt in the Resolution Center, as long as you have allowed enough time for the item to arrive.
