I wonder if your decision of settling “the claim in my favor” is really in my favor after all!

Hi there, I'm really upset and I need to hear from you if there is anything I can do.

Sorry for my english, but English is not my native language.

I've just realized that to be honest is not a big deal !! 😞

I bought a transformer and the item I received is not the same I ordered and - over all - it didn't works!!

In this quoted email I tried to explain the situation to PayPal but I cannot send it anywhere: the only thing they want is the tracking number.

But I cannot send it back because for me the shipping cost and the paid fee and import tax are as though as the price I paid for the trasformer and the refund by Paypal.

So if i send it back is like I have NO REFUND but the seller will have back his machine.!!!

What I have to do??

I've called the free Paypal number with no chance and now I have no idea about this damned situation.

PLEASE HELP

Thanks

Lio

Not as described - Claim - #PP-
To whom it may concern,

First of all, I wonder if your decision of settling “the claim in my favor” is really in my favor after all! Please allow me to explain the events as they happened.

On 21/11/2011 I bought a "LiteFuze 5000 W 110/220 Voltage Regulator Step Up / Down" as Voltage Converter (from 110 to 220) as described in the auction:

***********************
Designed for people who need to manage their business and personal lives equally well, the LiteFuze Voltage Regulator is a more affordable

and powerful Voltage Stabilizer. Its built in smart circuitry provides multiple layers of defense against harmful surges or voltage spikes.

Strategically placed copper coils will convert the current so you can use your items worldwide without worries. With the LiteFuze regulator,

you'll be able to easily convert and stabilize your power from 110 Volts to 220 Volts or the other way around. It's ready to run on any

power 110,120,140,220,240 Volts, enabling you to use anywhere in the world, while on the go.

The purchase was made after having asked the seller if this equipment was correct for its intended use, and confirming by email that this was a Christmas gift for my daughter (explaining why we reported the problem only after 40 days).

As soon as we tried the unit on January 2nd, we realized that it was not working and we immediately wrote to the seller:

Hi there, I've just tried to use your LiteFuze 5000 W Voltage Regulator 110/220 Step up/down but it doesn't seem to work. When we first tried the converter with the old 220 canadian plug, the Thermomix turned on but doesn't actually function (i.e. the lights turn on but the actual appliance doesn't work). We tried changing the plug putting the original Italian plug back on, but to no avail. Just so you know, we have a 220 plug at home that we use our Italian appliances on, however, my daughter does not in her apartment and that is why we decided to purchase this voltage regulator. So long story short, the appliances work on the 220 plug that we have at home but do not work when using the LiteFuze. Also, the instruction paper says that we need to "select the input voltage according to country's voltage on the transformer" however, there are no buttons (or whichever other thing that can be clicked) that can be used to select this. I assume this is because it is an "automated" voltage regulator - as it says on it, therefore I'm thinking the instructions paper was wrongly placed within our item's packaging - however I'm not 100% - you tell me 🙂 The reason I am only writing you now is because it was a Christmas gift and it was only opened a couple of days ago and for the same reason I didn't give you any feedback till now. Please let me know AS SOON AS POSSIBLE, since my daughter ought to go back home shortly. Thank you in advance.

We had an initial response by email from a guy who said we had to send it back and they would change it. At this point we have directly called to clarify that it was not possible for us to send back the unit at our expense as from Canada to you the minimum amount required was 76 CAD either by Canada Post or via FedEx or other courier. It was rather obvious that the company has an agreement to ship the machines via UPS as the shipping we paid was $ 15.

After a phone call with the seller, we have reached a verbal agreement that they would send us new equipment as well as a pre-paid shipping coupon for us to send back our malfunctioning Litefuze. To have written confirmation of this, we immediately wrote again to the seller asking for a confirmation of the discussion had by phone.

Dear *************************
this is Lio, I was just speaking to you on the phone in regards to the LR 5000 (Lite Fuze Automatic Voltage Regulator). You said you would send me the LT 5000 along with a return label for the LR 5000 that I have here. This is just to confirm what we said on the phone, as you told me to email you.

This is my address:

and this is my phone number:

I would appreciate a quick reply to confirm this transaction because I have only two days left to eventually make a claim through paypal.

Thank you for your cooperation and swift understanding.
Sincerely,

We received no reply to this, so we wrote another mail

Hi there,
I just tried calling you again in regards to the LR 5000, to get a confirmation about what we had said yesterday on the phone. We have sent two emails and have yet to receive a response. If I don't receive a confirmation email within the 5 hours from now, I will have to send a claim through paypal. I hope it won't have to get to that level. I'll be waiting to hear back from you. Just in case this is my email

Still no answer and as that the time to be able to address you for a refund was ending, I wrote to you, but I was pretty sure the situation would end in a positive way because of the assurances I had received from the seller’s staff on the phone.

Now you tell me that you have decided in my favor proposing me to send back the transformer at my expense: the shipment of 45 lbs from Canada to Chicago would cost:

Canada Post: without insurance
Expedited Parcel - 70 CAD
Xpress post - 114 CAD
Priority – 364 CAD

FEDEX
Fedex International Ground - 72 CAD
Fedex International Economy – 230 CAD
Fedex International Priority – 80 CAD
Fedex International First – 440 CAD

In addition, consideration must be given to the import duties and taxes - of which I have a receipt - which I paid to the courier (UPS shipping cost $ 15) for a total of $ 50.41.

What I ask is to receive a new unit functioning properly (a transformer stabilized 5000 W to convert the power from 110 to 220 exactly as stated in the presentation of the product I purchased and vice versa), and a pick-up of the unit I have here, already packed and ready for delivery to a carrier (which may be the same one that gave me the new equipment).

I would be willing to share the cost of double shipping for a total of $ 15, but not to lose $ 42 in taxes paid (and obviously I don't want to pay for the replacement unit) as well as for an extremely expensive (for me) shipping option.

As I said on the phone and by mail, we want to have this equipment because we were assured this was the best for us and therefore a refund without a new transformer does not seem an option for us.

I look forward for news and thank you for your assistance
Lio
