item not as described from a private seller

Hello to all

Looking for a bit of help advice please, i bought and payed via paypal for a guitar that was advertised on ebay but the seller took it off ebay and sold it to me privately, i bought it as described in the ebay sale, and we negotiated a price privately.

 

I have received the guitar but it was supposed to have a pickup which was worth a £1000 alone, this was part of its appeal when advertised and was mentioned as such, i.e. comes with a PAF pickup.

Now it transpires the pickup is not a PAF as described but some other non- descipt thing, im sure the seller thought it was an original when he sold it, but i had my doubts an had a professional opinion who clarified it as Not a PAF PICKUP.

 

Now it is a significant difference, i mailed the seller and he isnt happy as he discounted the guitar to sell it to me, but i pointed out it was sold as having the paf pickup which it doesnt, so i asked to return the guitar for a refund, or for him to refund the difference of the pickup cost,

His attitude is a "deals a deal" and he will refund £200 as a gesture.

Will PayPal help and refund in such a situation?

Firstly a lot depends on how you paid.

 

You are covered if you used the send money > goods option or via an invoice he sent you.

 

If you paid via services or gift / family or friends option then you may still be able to file a claim but if the seller refuses to refund then paypal will not do so under their buyer protection scheme as that only covers items bought as goods.

 

If you did use goods then file for item received but not as described via the resolution tab in your paypal account....put in clearly what was in the description etc and wait a few days for the seller to refund or respond, if nothing is settled then escalate the dispute to a claim.

 

No one can say what decision paypal will come to but if they find in your favour then you will need to send the item back trackable at your own expense before the seller has to refund.

 

If the seller offers a refund before paypal have found for either of you make sure you send back trackable so you have proof the seller has the item back again.
