I would like opinions about a possible claim

I purchased something from Etsy that was described in a title as well as in the description.  The description states that the piece is stamped with the same name as the title.  However, the picture does show one of the letters stamped upside down.  I didn't see this and was going by what was stated in the title and description.  I have contacted the seller and was told that the picture was what I should go by.  I don't want the piece with the upside down letter.  Can I reasonably mail my piece back to the seller and cancel my payment?  Or am I in the wrong?  I have never run into a situation like this before and want to do the right thing.  Thanks for any feedback you can give me.

Many Etsy sellers have a way of writing extremely confusing titles as they are encouraged to stuff all sorts of words into the title for best search results and cover as man possible ideas for the product.

Personally, I find the practice extremely confusing.  My opinion is that the title should accurately describe the product.  This should be supported by pictures and descriptions.  There should be no reason to explain why the title dosn't matter.  Buyers do want an accruate title, pictures, and description.  To say a buyer should ignore the ittle and rely on the picture is a bad business practice.

 

If the title was decetptive, by all means pursue the case.

 

What to do?  You can't just mail the item back for a  refund.

 

First, let the seller know that you are unhappy and that the title is deceptive.  Make sure you are very clear with the words and phrases you use.  Actually, for a seller to offer a deceptive product, the seller should pay return shipping.   Let the seller know that.

 

If seller does not agree, then file a dispute with PayPal, stating your claim very carefully and precisely.

This is a case of item not as described,you can file with Etsy first,then Paypal,then credit card issuer if you paid with the credit card.

If one letter is upside down,it could be a fake or countefeit or knockoff.

Etsy is know for one of a kind artist creation and would not tolerate knockoff,tell your seller she could face being suspended by Etsy.

As for who should pay for return shipping,neither Etsy or Paypal can enforce seller paying return shipping for item not as described,only Ebay can with domestic order.

You have to negotiate with seller .

There are plenty of fake,counterfeit,knockoff in cyberspace from designer handbags,sunglasses,t shirts,jewelry,paintings,dvd.

The Chinese made hinged porcelain boxes can be stamped Limoge,China,but there is no town or city in China called Limoge?

There is a company in CHina called Tiffany Co,so small silver trinklets are stamped Tiffany which makes our Tiffany so upset it takes Ebay to court and LOST !

There are art farms in CHina where artists painted Andy Wahol,Chagall,Picasso,Dali paintings and signed them but they do acknowledge these are just copies.
