Custom made item not received, refund?

I paid for a custom made item in another country. I was told it would be delivered in about 8 weeks. It has been 4 months. The seller has told me a couple times they got a big order and mine would take longer. With some effort I am able to contact them and they keep saying they will send me an update but they have not. I know custom made items are not covered by refund but why not even if it's never recieved? That is a blatent rip off. Not a problem with opinions, quality, not as described, etc.

Why don't you file a dispute for item not received?
Did you read the PayPal policies for PayPal buyer protection?
