is it lawful or not that my credit card bank charged me foreign transaction fee?

I am in New York. My credit card bank charged me foreign transaction fee, because they said that seller is out of the States, who can tell me this action by my bank is lawful or not? My own understand is this action may be unlawful, because mechants receive moey from Paypal who charged the foreign transaction already. is it correct?
