UPS Claim for Lost Package

Hello,
I recently sold and shipped a Macbook Pro (8-31-2011) to the buyer via UPS.
I shipped directly from UPS.com since paypal's maximum declared value was only $1000.00.
All the information from shipping address, ship to address, declared value $1300.00, signature required, and etc. was put correctly and the item shipped.
9-7-2011, the items estimated delivery date was not met. I contacted UPS and UPS placed a tracer on the item.
Tomorrow 9-20-2011 is the last day of the tracer investigation and I will need to file a claim through UPS.
My question is, do I refund the buyer the $1300 funds right away or do I have to wait for UPS to send me a check first?
According to UPS's website, "If UPS locates the package, the claim will not be approved"
I don't want to refund the buyer and have UPS locate the package and not process my claim.
