Item left on doorstep but not there on return from work

Hi

 

I ordered an item from a UK company to a UK address. The parcel was sent by Royal Mail with a tracking number and was left on my doorstep whilst I was out. When I returned home from work the parcel was missing but a photo has been provided by royal mail of it outside my home alongside confirmation of delivery.

 

The location Royal Mail left it in is very exposed and I did not give them (or the seller) authorisation to leave it outside my home. If I need to raise a PayPal dispute, what is the likelihood it will be successful? I understand that PayPal will generally favour the seller where a tracking number shows delivery. However, this seems to be in contradiction to UK consumer rights that place liability with the seller where a courier has failed to deliver the item. I understand that the fault likely lies with Royal Mail, but it was the seller's decision to contract out delivery to Royal Mail and - from my understanding of consumer protection - they therefore retain responsibility of ensuring the goods ordered are physically recieved.

 

I've had a similar experience 5 or 6 years ago and was able to raise a S75 claim with my credit card company at the time but I will be gutted if I've lost consumer protections by using PayPal to purchase this item.

In the event of an item not received dispute paypal relies on a tracking number that proves delivery of the item to the buyer.

If every buyer stated item stolen and so got a refund it would make the tracking number requirement meaningless.

Your issue is with the seller and Royal Mail.
