Asking about transaction disputes

Hello, at the end of May I made three purchases from a seller. They shipped what they had and put the rest on back order and after reaching out to them they said it would be here sometime July-August. It's halfway through August now, I reached out to them again for an update, now they're saying August-September. They also say I can't get a refund at this point as more than one month has passed since the transaction was made. My question is, is this grounds to file a dispute? I've given ample time to get what I bought in stock and now they are saying it'll come later, I'm worried if they are trying to wait out the six month window for me to dispute a purchase.

You have the option to file a dispute for non receipt of item > put in what has happened and if the seller does not ship or refund escalate the dispute to a claim.
To win a dispute of non receipt the seller would have to provide a tracking number that shows delivery to your postcode etc.
Advice is voluntary.
Kudos / Solution appreciated.
