Xingyao e-commerce Co., Limited - Scam company

Hi,

Like a lot of people on this forum, I have been the victim of the whole order then get a different cheaper item. I opened a dispute with the company because I never received the item. We went back and forth for 20 days and then paypal stated I had to escalate my claim or it would be closed. I did so. The item then came in the mail and was not even what I ordered. I let paypal know, and included pictures. Paypal stated I must return the item even though I was sent the wrong one. That would be fine except the cost to send this back to China is huge and currently the post office says they cant accept packages to China because of the virus. I feel the company should have to pay return postage since it was their mistake, or resend the correct item. Now that paypal has stated I must return the item, I can no longer write anything on my claim, only the return tracking number. My text messages to paypal go unanswered. This company from China is one of many doing this while bait and switch thing. But from what I can see, paypal does NOT protect the customer, and is actually encouraging companies to continue this fraudulent practice by letting their practices continue. I mean I was shocked how many people have left posts here and yet Paypal ignores what is happening. In a previous post, someone had given some links to places we can lodge a complaint. Maybe the FTC?  Can someone send me that link again please?  and any other place where I can lodge a complaint?

thanks

I normally call the PayPal number in the help / contact section on the PayPal website.

Then you have to go through the menu system, and there is a prompt for fraudulent activity.  I can't remember exactly what the prompt is, but it was pretty clear what to press when I went though it a couple of times this last month.

I was always able to get a live representative by being persistent with the prompt menu.

Hope this works out for you.

I have the same issue with this company, it looks like a common scam

I ordered a 160cm paddling pool, they sent a 30cm popup bowl! and are refusing to refund unless I post the wrong item back to China

They have given 3 different return addresses and I cannot find a telephone number anywhere for them

I kept pestering them via messages, and it worked. I got my refund, but it's a courtesy, because blah, blah, blah. Like I kept on saying, I'm happy to ship it back, the company just needed to email me a prepaid shipping label for the item, I would not pay to ship it back.

Keep at it, folks. Bring up fraud and ask for a refund based on the fraud.

#worldtriad, great news, well done, I did try all that you suggest to no avail unfortunately. Do you remember the name of the agent that gave you the refund as I honestly believe it's the luck of the drawer, dependant on which agent you get as some are clearly more understandable and nice.

There have been a number of people, including me, who have been scammed by this company.  It is a “bait and switch” scam and PayPal is being complicit in this fraud as they do not protect the honest customers (I.e. you only get a full refund if you send the “wrong” item back with tracking, which costs a lot more than what you originally paid for the product you wanted, so you end up losing money and the fraudulent company gets to keep the money as most people will not return at a cost).

I live in Canada and I have reported it to the Better Business Bureau as well as the Canadian Anti-Fraud Center of the Royal Canadian Mounted Police. I strongly suggest you do the same, wherever you may live.....we can’t let these scammers get away with it!

They actively discourage you from returning the wrong item:

Dear Customer, We apologize once again for failing to provide you with a satisfactory product. You are not satisfied with the product and need a full refund, which is reasonable, but our company needs to receive the product you returned first. I can pay you the shipping fee you paid when you bought the product, but the shipping fee for shipping the product back to China is nearly $20 or even higher. Moreover, you will spend unnecessary gas costs on the way to the post office. Due to the influence of COVID-19, it will take a long time to ship these items back to China. Therefore, at this stage, proper compensation is the best way to solve this problem. In order to minimize your losses, our company is willing to increase your compensation to 55% of the total order after many consultations with the person in charge of the company. If you think that the received product can be use in daily life, you can keep the product without spending long hours returning it to China.

Paypal have just refunded me the £15 it cost me to return it https://www.paypal.com/uk/webapps/mpp/refunded-returns

So Im hoping they will have to refund me in full soon.

Dont let them get away with keeping your money!

Exactly the same thing for me. The pool I ordered was 160 x 30cm and the one sent was 30 x 12cm amd took over 2 months. I have sent it back and paypal have agreed to pay the postage. I now have to wait until the package is received before I get a refund! Watch this space. This company should not be allowed to trade and offer paypal payment.

I wonder how many more people got scammed by this company??. Ordered the rechargeable pressure washer advertised on FB only because it was supposedly endorsed by them, and also paypal, so at least some comeback if item never arrived, Surprise surprise, item turned up and not what was advertised, got the cheap hose attachment that wasn't even advertised on the website. I'd already reported the item as not received due to the not arriving in the stated time limit by at least 4 weeks, item arrived 7 days after dispute was opened, so upgraded dispute to item "not as described", after a lot of messages back and forth to paypal, seller asked to accept a $3 refund obviously refused this and was told i needed to return item to sender for a full refund but at my cost, to be fair paypal sent me a link to reclaim my return postage cost which was significantly more then the item was worth, so did as asked and had a message saying my refund will be in my account within 5 days. now just need to wait for a full refund from the seller, will keep you informed how this works out.

It's a shame about companies like this that are just out to scam people, as i order a lot of stuff from chinese based sites and have never had a issue, think i will just stick ti the ones i trust in future, even if they are supposedly endorsed by well known names!!!

Wow I the amount of people scammed by this is ridiculous. I ordered a 120cmx30cm pool and received a 30cmx11cm dog dish! I am having the same issues, they offered me a minute refund IF I sent the product back to them. (I would gladly send it back if they paid for shipping, after all this is THEIE ERROR, Not mine!) I have asked for the fraud department in the message center about 50 times and have been told because of Covid they are not available. They state they will report the issue directly to them, but they don’t consider this transaction to be fraudulent because I actually ordered a product from the company. I am so frustrated, and I want my money back!
