What do I do now? Small claims court?

Hello all,

 

I'm having an issue. I filed a dispute for a damaged item and was told to return the item for a refund. I returned the item with tracking information to prove it was delivered. The case was closed in the seller's favor and I did not get my refund. I messaged paypal on the paypal website. They filed an appeal and reopened the case. Then the case was closed in the seller's favor again. I messaged Paypal on Facebook. They appealed the case. Then it was closed again. This has happened 4 different times. I feel like I am all out of options. Is my only recourse small claims court?

 

 

The email I get when the case is closed each time is as follows.

 

We received the case(s) you filed on February 10, 2023.

We have reviewed this transaction(s) and are denying your case(s). This decision was made because we did not receive valid proof or tracking that you returned the merchandise."

Hi Tenatra,

My appeal was denied.  They ruled in favour of the seller again, therefore condoning the bad business practices of the seller to continue using Paypal to rip off people.  I am going to report this to the BB and any other place I can think of.  Thanks for letting me vent on your post.  Cheers.

File a complaint with the Better Business Bureau.  I did and am getting a refund back.

As a final follow-up. I went through the better Business bureau and they issued me a refund " because I've been a customer for 15 years", but they also stated they felt that they made the correct decision of not refunding me originally because I didn't provide a tracking number even though I had no address to send it to. That being said, after gaslighting me and putting me through all of this, I will gladly just use another payment service from this point forward.

Awesome! Exactly what they said to me...the correct decision was made as I did not provide a tracking number but they would give me a one time refund.  They thanked me for informing them about the merchant and would start a file on the company.  I am leaving Paypal too when I received my refund.
