refused refund

i recently purchased a laptop from a seller on ebay i recieved the laptop all fine in working condition.

after about 3-4days of using it i noticed every now and then the screen would flicker black for about 1-2 seconds.

i contacted the seller they said i can return the laptop for a refund i sent the laptop back in perfect condition and they recieved it today saying they are not going to refund me because the screen doesnt flicker and that i have updated the laptop from windows 8 to windows 10.

on the listing the seller has said they can update to windows 10 if the buyer wants it. so i have no idea why they are making it out as windows 10 is a big problem.

i cannot open a ebay case yet because the return item thing is still open and i dont think it can be closed until the seller does it which they wont after asking 2 times.

i have said i will open a paypal case to get my money back but they have said i will 100% loose the case so i have no idea  what to do as they now have a laptop i have paid for.

If ebay don't help you then open a dispute with paypal, as long as you have a tracking number to prove delivery of the item back to the seller then chances are good.

 

Just make sure you put EVERYTHING into the dispute before you escalate to a claim.

ok thanks if it comes to that i will. the seller has decided to listen to me and is going to downgrade from windows 10 to windows 8 after me givig instructions but you would think someone who repairs and sells computers for a living would know how to do this.

 

if i open the case and loose will the seller have to return the laptop?
