Open a dispute after 45 days of payment?

I placed my order on June 5 and went on a vacation, to a place without...eh internet. So When I got back and check my order status, it still didnt shipped yet. So I immediately sent them an email on June 17. Not until June 19 that I got an email saying that my order has been shipped through USPS First Class Mail International Parcel but they did not provide any tracking number. Also note that the payment was processed immediately on June 5.
I tried to contact the seller but got no responses so far.
So I decided to open a dispute and here we go, 45 days limitation.
Is there anyway to get around with it?

PayPal's policy is 45 days from the date of purchase. Once past the 45 day window, if you paid with a credit card, contact the card issuer, it's possible they can help.

I myself placed an order and several weeks later went on vacation camping up north where there is no internet. I usually give the seller a few weeks because I know that postal delivery service can be lengthy at times. After 3 weeks, we returned home and began to catch up on bills etc. It was only then I learned that I had not received an expensive item I had purchased. I contacted the seller twice with no response at all (as ebay directed me to do).
Well, the 45 day limit had been passed and I subsequently learned that there was nothing ebay nor paypal could do. I choose paypal for security. I am outraged that I am "out of luck" and out of my hard earned money. I cannot beleive that there are no exceptions to this 45 day limit. What about someone who has a medical emergency and is hospialized???
So much for feeling safe with paypal - what a joke. I remain bewildered knowing that paypal is allowing this criminal to defraud its members and does not care, nor do they wish to do any kind of follow-up. As you can tell, I remain very, very upset at this whole situation.

The bigest flaw with this payment system PayPal, is that PayPal pay the seller before the buyer get his item, for this reason every one has a problem with that, if they pay after we get our item than it's ok for both side, cause the money is already in PayPal account and as soon as we get the item we should sign for post man that we get it and that's it.

Call the credit card you used for the transaction and file a claim. They usually have an insurance coverage for card holders for purchases such as this. They will open a claim, contact PayPal and work to get your money back. Be sure to do so very quickly because they have a time limit (longer than paypal) for opening a claim for the purchase.

i'm in the same boat.....only i tried to deal directly with the seller as paypal prefers...........now i'm out $$$..............:(

I am on the same boat too..... Paypal first encourage me to try to resolve it with seller. The seller promised to send me the item "again". Here we go I've got nothing and these 45 days passed. Damned Paypal. I just realised that the seller is a frauder and he made me waiting for the period more than 45 days.

Same thing just happened with me. I bought about $20.00 worth of items from tmart.com, and after 3 weeks the items still hadn't arrived. I contacted the seller and they told me to wait 45 days to see if items arrive late, because they were shipped from China. After 45 days, no items. So I file a ticket with tmart.com, and they just ignore it now. They refuse to give me a refund.
Then I go to PayPal to file a dispute, and now I see why they told me to wait 45 days. I feel so stupid, how they tricked me.
I am confident they are a fraudulent operation, and PayPal should have blocked them a long time ago. If you Google for "tmart.com didn't ship my item", you will see there are tons of people with the same problem. So now more than 10 weeks have passed, I never received my items after all that time wasted, I lost $20.00, and PayPal still doesn't lock the account of this fraudulent company.

The exact same thing happened to me. Once the 45 days has passes then ebay or paypal no longer want to help, they have had their money out of the deal so they are happy and then its up to the paying customer to sit back and count their losses or try and recover money owed to them. There seems to be more and more of these fraudulent traders appearing on ebay, making people wait out the 45 days before ripping them off. I have reported them to ebay numerous times and also filed complaints with ebay but ive never had a reply back from them, seems the only time ebay wants to contact people is when your late paying them fees or they cant retrieve fees!!!!!!

PayPal and Ebay should do more to inform customers about this limitation! Infact the limit should be 60 days and a warning should be posted about this when you go and purchase. I had no idea. Seems like it is a benifit for crooks to use paypal since it will protect them. Thanks for nothing paypal!
