seller did not respond to my paypal claim - what happens?

I bought a phone on ebay for my husband as a gift for when he gets home from afghanistan from a seller who had 100% positive feedback, needless to say he stole my money, never sent the phone and dropped off the face of the planet. On ebay there is no tracking number so the phone has not sent and I did file a claim with paypal to get my money back but the seller has not responded to paypal. What happens if he doesn't respond to them, will they still refund my money? He did this to 8 other people so I'm sure there are multiple claims for this person. Will they see he is a scam artist and use that to side with me, the buyer, since he is not responding? Thank you.

the last time this happened to me the seller had so long to reply or else the money was automatically returned. however that was years ago.. paypal is so **bleep**ed up now, who knows. call paypal and ask them directly.
