seller did NOT insure the item as i requested

i bought a laptop on eBay. asked about direct payment to his paypal account, he accepted it. item price was $644.88 and shipping cost to Rep. of Moldova (where item needed to be sent) - $100. i asked him about the insurance cost, he answered total amount is $745 including shipping insurance. i sent him the payment. when the package arrived to Moldova, i received a call from the post office, staff representative told me that a package arrived for me, but when it was checked by Local Customs the content appeared to be missing. The laptop was stolen during transit. When i contacted the seller, he said that the package was not insured because i didn't pay $7. when i asked how was it possible not to insure the package when he told me by himself that insurance is included in the amount i sent him? he couldn't answer this question. in his last email he said: i don't have the laptop what can i do? seems like he doesn't understand that i don't have it either, the package was sent back to him with Customs Act, or he is just a person who cares only about his own problems. he got my money and he's happy. now it's almost 2 months since i try to get my money back. the seller doesn't even reply to my emails anymore. PayPal denied my claim, because by their Policy they are not responsible for item loss or damages, this is Postal Service's responsibility and seller has to work the things out by himself. help me with an advice who can. thanks

Did you file and INR?
If yes then that paypal resonse is a bit strange. Call Paypal and talk to them to see if anything can be done since they closed the dispute and you did not receive the item.

what is INR and is it possible to appeal again if paypal already rejected the claim? because their decision is unmotivated, i can even give the tracking number and there is shown that how the package arrived to me, it was sent back to the seller and i got nothing from it. and their decision to reject the claim makes no sense.

If the box was delivered to you (even empty) then you would have had to file an SNAD - Significally Not As Descibed
If you file and INR Item Not Received and Paypal looked at the tracking they would close it denying your claim because that tracking number would show it was delivered to you.This sounds like what happened in your case.
Unfortunately you can only one or the other - not both. And again since it is over the time limits sadly chances are there is really nothing that can be done.
Give Paypal a call though to make sure.

no, the tracking number showed not as "delivered", but "processed by local customs", and later it shows that the item was sent back to the sender. i didn't even touch that box. i just have a feeling that paypal didn't even research this case. in the report was shown that the seller didn't even reply. so there was no any additional information. and i consider that this decision is absolutely unfair. i'll try to give a call, and will let you know the result. just for curiosity.

If you originally filed for INR (Item not received), you may have to switch your claim to SNAD (Significantly not as described).
But definitely call Paypal and APPEAL the deision - don't try to open a new claim, that's not allowed.
Speak to a supervisor if the phone answerer can't hep - sup's have more latitude sometimes.

how can i appeal? is it possible somehow to ask paypal for a new investigation? i guess they can tell me that if the paypal claim is denied eariler there is nothing i can do, like i can't open a dispute twice for the same item.

I keep telling people it's never a good idea to buy expensive items through sites like Ebay. It's too risky. My friend just bought a $250 refurbished laptop through Ebay. I told him nest of luck with that purchase. If you can shop Newegg, do it. You thought you were saving money, but how's that laptop working out?
