PayPal is violating its own policy Section 10.2 - FILE FTC COMPLAINT

Where is the policy change that allows PayPal to arbitrarily hold funds - including shipping which is not refundable anyway under my return policy - on some sales but not on others. I sold a laptop as broken for parts. It was delivered 3 days ago. There is no claim filed. I sold a working computer worth twice as much 2 days later and no hold occurred.

 

This CANNOT be legal - especially when my accounts are 100% - never an issue from a buyer???

 If this has happened to you, go to the Federal Trade Commission site (FTC.gov) and file a consumer complaint.

Beginning October 14, 2009 PayPal user agreement is being amended as follows:

We are revising section 11.3 as follows:

  1. We are moving it. It will now be section 10.2.
  2. We are expanding this section to allow us to place a temporary hold on amounts subject to a claim filed by an eBay user, through the eBay resolution process, if your PayPal account is your eBay reimbursement method.
  3. The new language will read:

“10.2 Temporary Holds for Disputed Transactions. If a buyer files a Claim, Chargeback or Reversal on a payment you received, PayPal will place a temporary hold on the funds in your Account to cover the amount of the liability. If you win the dispute or the transaction is eligible for PayPal seller protection, PayPal will lift the temporary hold. If you lose the dispute, PayPal will remove the funds from your Account. This process also applies to claims that a buyer files directly with eBay through the eBay resolution process if your PayPal Account is your reimbursement method for buyer claims.”

Exactly.  Even if Amazon's items are sometimes more expensive due to it not being auction format / not having used version of things like clothes etc... I have lost WAY more money using Ebay/Paypal in the last 6 months than I ever would have amassed by paying a few dollars more here and there on Amazon.  I've completely abandoned my Ebay and Paypal accounts and I'll never use them again (except for this 😛 ).

 

Oh and I also agree about trying to talk to these people.  They give obvious pre-programmed answers which sometimes don't even relate to my issues, proving that none of them actually understand the case, they are just looking for buzzwords and then hitting the buttons they were trained to hit when they hear them.

 

I really wish this whole issue got more news / media publicity.

I'm a journalist from Reuters and planning to look into this. Email me details of your complaints to richard.baum at reuters.com. I sold a laptop to someone who paid by PayPal and collected from me. PayPal initiated an investigation, unprompted by the seller, and says it will reverse the transaction unless the seller confirms receipt. The seller is not responding to my requests that he does so, presumably because he knows that he will get his money back and keep the goods if he does nothing. The PayPal person I spoke to on the phone says I should have read the guidelines that stipulate I should ship the goods.

You are so right.  I want anothe option however in my line of sales Amazon is not currently accepting sellers.  Ebay and Paypal are unacceptable.  Their customer (the seller) whom they make ALL their money from are treated like second class citizens.  The sellers customer (our responsibilty whom we make our funds from) is treated much more fair and with no disdain. 

 

I just don't see how they are going to build their financial empire.  I'm a Top Rated Seller with 100% feedback and 4.9 DSR's.  Yet I'm dissatisified and longing for a change.  Oh, not a Obama change, a change that works for me, the seller, the one that pays the bills. 

 

You know what they say... no seller, no buyer.

 I could not agree more. ebay/paypal has turned a reliable payment system into a sellers nightmare. As you read (which I know you have) they state they MAY in SOME CIRCUMSTANCES hold the sellers payment .Into a non stated WILL HOLD your payment.

 I believe that ebay/paypal are putting our payments, that are millions of dollars, into a place where they get interest on our money. Besides a cash flow problem they may be having this makes the most sense as to why they are driving their sellers off.

 I in the auctions that I have state that I do not  accept paypal..Except for a e-check. Plus I handle my own credit card merchant services.

 I can not stand the way they treat their 100% sellers that have been doing business on ebay for many years. Count me in for any complaint.

I would just like to chime in and say, my very first experience with PayFoe has been a disaster! I just wanted to buy something, seemed simple enough. It wasn't. They won't let me use my own Ccard to make a purchase and my conversations with customer service have left me in a sweaty rage! I hate Paypal and this will be the one and ONLY time I attempt to use it. Cheers...

It's happening to us as well, no complaints, high DSR, 8800+ feedback and still even after, items delivered, deliveries confirmed and positive feedback left by the buyer, Paypal holds the funds, how can this be legal and why is paypal allowed so blatantly to lie, (about their policies) and more importantly why are we not getting interest on the money that paypal holds?? This does sound criminal.

Well I'm ticked!  I've never trusted eBay at all and never will!  I have dealt with PayPal since 2001 with no problems. So now they are holding a whopping amount of $41.00 for up to 21 days because I am a

 

                                                                               "high risk to the buyer of a hat?????"

 

I have to be sure to keep a paper trail and be able to prove that the item was delivered, and the buyer must leave positive feedback, shipping and received confirmation, openly communication with the customer and enter tracking information.  How much more is that going to cost me? I didn't figure the extra cost and time into the cost the buyer paid. The hat is worth more than what the buyer paid.

 

I called Paypal. They must have their call center in India. I couldn't hardly understand the woman on the other end and all she did was read the standard reply, I'm sure. I'll try to cancel the sale but we all now how much help eBay will be with that!  I'll gladly let the buyer have their $41.00 back and I won't be dealing with Paypal again, never, ever!  I don't need the extra stress in my life. I was just cleaning out things and hoping to get a few dollars (which I can use). But, I'll just throw them out now or give them to someone locally, maybe even on Freecycle. EBay and Paypal can eat my dust!!!!!!

I get people from The Philippines. These people are just trying to make a living and given a horrible job of trying to have the sellers accept a policy that is at best insulting and hopefully illegal.

 As for the paypal CEO....I hope he/she/them are reading my comments. With right is might...they are cowards shooting at their own toes.
