if something is not covered in PayPal policies eg- send an item with pending payments- can I take a case of unpaid item to court, if I did am I likely to loose because of the policies?

If an item was sent when payment was pending which which is not covered in PayPal policies and payment bounced
a) is the buyer obliged to send back the item?
b) could I open a small court case against them if they didn't and would I loose because I sent it when it wasn't covered?
