complaint against paypal resolution centre

Um, ... 

 

I appear to be lost in the system and wonder if there is an obvious route that i am missing. 

I want to make a formal complaint against both paypal and a seller. My issue is pretty basic i think, i ordered something on line, they werent able to deliver it on time ( missed the deadline by three days) and then when i called to cancel they refused to accept a cancelation and sent it anyway - another three days later. I asked for a case to be openned as i know i am covered by the law but incredibly paypal ruled in their favour .. i had cancelled the order within 7 days of placing it, and they refused to allow a cancellation and sent it , how can that be ok ? Its a weird situation to be in as i am normally pretty chilled out but the seller was so darn rude i feel i have to make a decent stab at ensuring they dont do this to other people. So ... long story and probably not the place on here but i was wondering if anyone has any ideas? i have tried to enter onto the formatted form but the system keeps throwing me out, i no longer live in the uk so dont want to incur charges calling internationally... any ideas ?

Whilst paypal does not stop you from pursueing your legal rights they can't do that for you.

 

All you can file for on paypal is item not received..........but it was.

Or item received but not as described..........presumably it was described ok.

Or unauthorised payment ie hijacked account and used without your consent..........it wasn't.

 

Also your legal rights may be reduced if the seller was not a "registered company" ie a private seller.

 

If they were a registered company then you have the right to cancel and if they have sent the item anyway you can return it and ask for a refund......but if they don't refund you would have to pursue it in the small claims court.

 

If they were an individual then its doubtful the rights to cancel are the same and as long as they abide by ebay and paypal rules then you can't cancel unless the seller agrees.   

Ebay states your bid is a binding contract.

as the item you ordered a bespoke item??? made to order with personal requests ect??? does make a difference to the cancellation laws
