o i bought and ipad 2 it cam as an ipad mini asked seller for return , no answer. i waited couple days opend a case on ebay, no answer, wait couple more days open a case on paypal, got a reply from seller saying sorry ive spent the money, escalleted claim , sellers never relied , casze closed in my favor was told, that i can now keep the item, one week later seller ask me to return the item, never even offered to pay postage  for  the return and said if i want to keep item i can send a cheque , so do i just ignore the seller and keep the item or do i responed asking for postage fees to send item back

The seller had ample time to ask u to send the ipad back and refund u they chose not to

 

Since u won the case and ppal didnt ask u to send it back then u dont have to

The case is over now so its up to u

Totally disagree on this one.

 

Would you really want to keep an item the seller has not been paid for?

 

Agreed paypal can't do anything but morally do you think its correct?

 

I would tell the seller that as you have been refunded you will return the item BUT he has to send you the postage costs to send it back trackable at his expense as it was his mistake in the first place.

 

That is fair to both of you then.

As a power seller and a top rated member on ebay , i get items return to me all the time, i as the seller have to pay for the cost of postage there and back no matter the reason the buyer wants to send it back, what i havnt been happy with is the way the seller just said im sorry ive spent he money theres nothing i can do,, , , think i will let them stew for a week or so like they did with me then ask for the posatge cost to be sent to me before i send it back

The seller made no attempts or reasoning to make amends to their mistake, didnt reply to the dispute, wants u to return at your own expense!! Whats fair about that!!??

 

Why should u be treated like that

 

I certainly wouldnt pay return postage

So thats why I said its up to u

I agree which is why I said to the OP to only return the item when the seller provides the postage costs.  Smiley Wink

 

But morally I would never keep an item I had not paid for just because I could get away with it.

Yes we know its up to them but personally I would rather advise them to do the right thing and return it providing the seller sent them postage to do so, which is what I DID advise them.

 

Also how they were treated was not the question, the OP specifically asked this >>>>

The right thing was to do the latter, respond asking for postage fees to send it back which is what I advised

Nothing odd about saying that at all if they rung ppal ppal would tell them they dont have to send it back as the dispute is over and yes it is up to them whether they do or not after the way they were treated

 

Buyer also said "what i havnt been happy with is the way the seller just said im sorry ive spent he money theres nothing i can do"Smiley Wink
