can someone help me with this, i sold a bag on ebay over 3 weeks ago plenty of pictures on to look at in my description i put ask questions before bidding/buying buyer didnt so they paid i followed seller rules sent bag by recorded signed for added tracking number,,all good,,3 weeks later for no reason buyer opens not as described case and paypal put my account into a negative.how fair is that,they have had my bag for 3 weeks and it has more than likely been used as i have dont accept returns they have now said its a fake which has forced me to accept a return,,why has it taken 3 weeks to decide its not as described, this bag was bought from ebay over a year ago, how can anyone prove that anything bought from ebay is not a fake, i put in my listing it was a gift i dont have a receipt so im stuffed,it seems to me the only protection you get from ebay/paypal is to be a buyer, and im so annoyed that buyers can file such cases after having the item for 3 weeks,,this bag will not be in the same condition as i sold it so either way im the looser,

if i buy from ebay and recieve the item and its not what it should be i contact the seller either same day or shortly after,,i dont use item then decide i no longer want/need it so lets file a case,,,this stinks to me of abuse of the system.....wheres my protection

Its against the law to sell fakes and you as the seller are responsible in making sure an item is not fake before you list it for sale.

 

If the buyer has bought it as genuine and its a fake then of course they deserve a refund from you. If not they could go to trading standards and report you as selling fake items.

 

Unfortunately ignorance is no excuse and its up to you to check an item out before you list it for sale.

 

If someone receives an item and thinks it may be fake it may well take them a few weeks to get proof of that before they file a claim.

 

You don't have any protection, its the buyer that deserves protection as you sold a fake item.

i never said it was a fake they said it was a fake, just to get a refund and no documentation has been submitted from the buyer it has not been sent away for any authenticity as if it had and it was there wouldnt be an item to return, as i said i bought it from ebay and ebay state they dont sell fakes but the site is rife with them,,,i think that she just changed her mind and as i stated i dont accept returns it was the only way to guarentee herself a refund,,i dont believe it to be a fake but cant prove that as like i said it was bought from ebay, so what your saying is never buy an item from ebay unless you go to the shop with the seller and get a receipt because no-one can guarentee an item unless its done that way,,,which leaves ebay redundant ,,,,thanks anyway for your imput,,,i will never sell anything again on ebay and if bag is not in same condition as when i sold it i will fight it all the way

You don't have to send an item away to confirm its fake, shops that sell the item will confirm and give you proof etc and if paypal have found in favour of the buyer they would have asked for proof it was fake before finding in their favour.

 

You are not supposed to even list an item unless you are 100% sure it is genuine and it sounds as if you are not sure yourself.

No they don't state that, ebay don't sell anything, sellers on ebay do. Ebay state sellers are not allowed to list fakes, but they can't check every auction listed and rely on buyers etc reporting fake auctions to them.

No what i am saying is you can buy what you like but any item you list to SELL you must be sure is not fake. The onus is on you as the seller to be sure the item is authentic.

 

Just because others may break the law / scam their buyers with fake items does not mean you should be exempt from refunding does it?
