I’m a buyer. Recently I spent nearly 30 pounds, only to receive an almost worthless item. I complained to the seller, only to get blame from him/her. Then I opened a dispute via PayPal to request a refund, but the seller refused to refund, and just one day after I opened the dispute he/she escalated the dispute to a claim. So when I see the seller’s fact-distorting narrative and personal attack against me in the Resolution Center, I was not able to add any comment and further information which would contradict the seller's story.

 

The status of my case stuck in the stage of 'Awaiting other party's response' for about one week. I logged paypal everyday, and yesterday I found in surprise the case was already closed. Actually I was waiting for my turn to offer further information and evidence which can prove that the seller is selling things dishonestly, but the case was closed without any notification in advance. It's unfair.

 

The main problem is the item I bought is intangible, the final decision in the Resolution Center stated ‘After careful consideration, we're unable to decide this claim in your favor at this time. The item is ineligible for PayPal Buyer Protection because it is intangible.’

 

Although I have already made an appeal via email to PayPal asking for reinvestigation and now am waiting for a response, I feel discouraged of winning this case and getting my money back. It's not big money, but I got almost nothing while the seller still hold my money, yet slandered me in the resolution center that I'm not a genuine buyer who just want to get something for free. How absurd the seller’s logic is! Who wants that rubbish. I feel disgusted every time when I think of the item I bought.

 

I admit I was too careless and gullible that I should have believed in such sirensong-like phoney advertisement made by the seller. But I didn't play tricks to rip off others, the seller did. Mainly because the seller withheld some crucial information and facts of the goods in the ad, I made the purchase decision wrongly. And now the seller's website with the goods is still running, there could be more victims, and when they discover the truth, it would be a headache to get money back. I searched the seller's information online and found they are based in UK. I don't live in UK, have no idea how it is operated in UK if I want to take further action to protect my rights, what can be done? It's my faith that the scam must not be protected and encouraged. Any advice?

If you are not in the Uk then you have no buyer protection for intangible items, you can buy them but AT YOUR OWN RISK.

 

Your only hope is that if you funded your paypal payment via a credit card you could contact your card issuer and see if they will chargeback for you.
