Unresponsive and unreasonable seller

I doubt there is much I can do but I posted this to see if anyone else here is or was in a similar situation as a buyer. I bought an item on September 9 and promptly paid for the item meaning less than 10 min after auction end. I send seller a message saying please send asap. I see that s/he has provided a tracking # but from experience know it doesn't mean the item was sent the tracking # statesitem should be here on 12-13. Date comes and goes with no item. I email seller asking for a refund because I am convinced s/he didn't send it b/c there is not update. Well I was right she sent it out later that afternoon on sep 16. I'm like whatever I have to wait at least a week longer. Next week around the 21 I see last activity on tracking was 18th. I send another email asking about validity of tracking info and s/he tells me they "assure you" it has been sent I am like ok. I open a claim w/ paypal on 22. Then later that day I check my paypal acct and see item is schld to come 23. I come home on 23 check mail and still no item. So I escalate claim and told I have to wait 11 days from date is last activity which was the 18th. I send two more furious but not vulgar emails to seller any where items is. S/he doesn't respond. So on 29th (11 days after las activity on tracking info) I call paypal, get refund, case closed. Laterthat nigh I purchase same item from a diff seller and again promptly paid. Well today I come home from vacation to see two packages. One from the second seller whom promptly shipped my item. And one from the firs seller who couldn't be bothered to respond to my issu. I see email in my frm paypal basically saying you have money and item pleas respond. Prior to this I sent an email to first seller saying I don't want the item and to accpt return. Then I call paypal and they say if she doesn't respond in 24 hours to call them back. The item comes 21 days after I paid. And one week after it was schdl to come in (23). I just think under these circumstances I should be able to return the unused/unopened pkg after all this unprofessionalism from seller. I know she doesn't accept returns but I was told by reps tha her policies don't apply to paypal. I just want to know what ppl think and or what I could expect the outcome to be.

Pisceschica- Well, that is a difficult can of worms. Every case can be a little different, but for the most part, if you have both the item and the money, we'll want one of those to be returned. Since you've already bought another, I'd say that rules out one of those choices. If you send it back with tracking then call us and let us know so we can note the case, I think you'll probably be good. As I'm not able to look over the case, I would suggest giving us a call, letting us know that's what you're doing, and we'll verify that that's the best option.
