Sellers says NEW but I received used and no original packaging. Paypal's answer: Sold as described

I bought an audio card that was announced as new. I received an open static back, no original box and no 50$ included vaucher coupons. I filed a claim. Paypal got the seller to win and told me that I received as described. They didn't even ask for a picture of the opened package nor did they let me see the sellers answer during the claim. They just chut me down with no refund or any type of proposition!

I think Paypal works for their own account instead of ours. I don't know what they mean by a "buyer's protection".

I was ripped of with their help!

Where did you buy this from?  ebay?  off-ebay?

 

You have no protection for 'not as described' on off-ebay items - says so right in the User Agreement.

Yes, bought on Ebay. item number 330446165117. Where the seller shows a new boxed set and puts the word new 3 times in a row in a single phrase, insisting. All I received was an opened static enveloppe with traces of use on the sound module card. Paypal did not protect me at all against this seller and I will lose a good amount of money with this transaction.

 

It would be impossible to sell this card honestly, and obtain the same amount I paid for the brand new one as announced.

There's a known problem with ebay/paypal's interpretation of the words "audio card".

 

They think it's a downloadable product, where you and I know differently.

 

I suggest you phone paypal up, get a supervisor and nicely explain that this is a real, physical item.  Get a picture of it and ask for an email address that you can send it to.

 

One person tried this and it worked, another wasn't able to change the person's mind, so you have half a chance.
