Can ebay rule against a buyer who didn't get the item?

I bought an item recently and the seller hasn't sent it within the specified time. I've opened a case and so far they haven't responded, but I did notice they have a -4 seller rating from ripping people off. The Ebay trouble ticket thing says after the 7 days I can escalate it and Ebay will make the final decision.

Could Ebay look at the items, along with other buyers who also haven't gotten theirs and say no, we're not going to refund the money, the scammer can keep your cash?

I paid with paypal. Should I have opened a case there instead?

If they sent  it and they had tracking on it you probably wouldnt have a dispute, if theres no tracking then you could dispute it through paypal if you go to the resolution center

Be patient, you have nothing to worry about. Escalate your claim/dispute as soon as you can and you're fine. Either you'll get a refund or hopefully your item arrives. Either way you should be good, the only hard part on these disputes and claims is having to wait out the time. Join the club!

Yes, you might b right, but it makes u never want to order anything online again. Is very frustrating when you send someone your money in good faith and they ignore all your emails and phone calls for what reason? I am clueless as to y anyone would advertise and not send when your money is already paid! Dont think I will ever do this again.

It is frustrating when you use your hard earned money on  items you want or need and never receive them, or when the seller will not communicate with you.

 

If you filed a claim with eBay, I would wait the 7 days and then escalate it.  If the seller does not have tracking and you do not have your merchandise the claim will more than likely be awarded in your favor.

 

Claims can be filed with eBay or PayPal, but not both.  since you filed with eBay you will have to continue working with eBay.  you have buyer protection so you will receive your refund.

 

The waiting is the hard part.
