Seller Shipped after Dispute opened

Hi all,

 

I (buyer) bought an item via private sale and the seller took 12 days to ship the item.  I had previously requested tracking multiple times with the seller unable to provide tracking information until the 9th day which just showed as label created until I filed a dispute on the 12th day, which then they shipped the item.  

 

Timeline: 

  • Payment sent Day 1 
  • Requested tracking Day 4
    • Seller responds with no tracking. 
  • Requested tracking again Day 6 
    • Seller responds that they will look for it. 
  • Requested tracking again Day 7 - asked the seller if they had not been shipped to just cancel the transaction. 
    • Seller says they need to contact the shipping company
  • Requested tracking Day 8
    • Seller sends over a tracking number (Shows as label created) 
  • Day 11 The label still showing as "Label Created" no movement
    • Ask for a refund and to now ship items out
  • Day 12 open dispute
    • Seller messages me asking why I opened a dispute and the tracking now updates to Item dropped off. 

Now that I have the items, can I ship them back on my dime and get a refund minus the shipping costs?  I no longer need the item purchased.  Will Paypal Buyer protection help here since the seller did not ship within the first 7 days and I had previously requested a refund/transaction cancellation?
