How do I get a refund on my credit card if I've been scammed?

I ordered clothing off an Under Armour website on Facebook that said they were having a huge clearance sale.  This website is a scam and I"ve reported them to the BBB and the postal service who is sending me proof that these items were never delivered to my address. I've explained this at length in multiple emails and I did have to opportunity to have 1 pleasant transaction with a representative on Friday night.  Unfortunately, they immediately denied my claim again. 

I've filed 2 disputes with Paypal and was denied.  Their response was to contact the seller who does not exist and neither does the email supplied by this "company" who also does not exist.  

 

I can not believe the responses I've been given by Paypal.   

Do I have any recourse at all?

Good morning, 

 

I'm sorry if my last email came off unprofessional and less than understanding.  

When I spoke to a representative on the phone, I was patient after being hung up on approximately 4 times before getting through she was very understanding and I gave her kudos for that.  This rep actually listened to what happened and could see on her end that the tracking number shows this package (which never existed did get delivered to my address) .   As we know this is not the case.  Now, she also said she was escalating the claim to her supervisor he sent me back the same response telling me to contact the seller.  

 

In response to your email, I'm happy to see you've earned the many badges you have for helping people.   I'm sorry to say I found you extremely rude and have reported you to Paypal because your response of "maybe I shouldn't buy something from China" I believe that was your end response?  Please know I will own if I've been rude to someone and this has been upsetting to deal with and honestly $71.00 is not a major issue to me.  It was the principle of Paypal not refunding the money for an undelivered product.   In closing,  you should know that the website this was ordered from had no indication of coming from another country and the prices were comparable to an outlet store so there was no reason to suspect otherwise because I would not have ordered these products.  So to assume one is stupid for ordering from "China" when there was no indication that is where it was from is wrong on your behalf.   I hope you have a great day and thank you for your professional response.    Please don't bother responding.  Kim

APPEAL

To submit an appeal on the dispute that was closed, PayPal asks that you obtain a detailed report from the shipper/courier (on their letterhead or some other form of official stationary) that includes the address the seller gave them for the shipment. Or one that includes a statement mentioning your address and saying the item was delivered to a different address.

When you have that, contact PayPal via phone (log on to your account and click Contact at the bottom of the page, however that may not be an option at the moment due to covid), or via Facebook (send a Private Message to PayPal) or via Twitter (send a Direct Message to @AskPayPal) and say you want to appeal the denial of the dispute based on the shipper saying the item was delivered to a different address. Once it's submitted (you will be provided with directions on how to do that), the dispute will be reviewed further and a determination will be made.

You also have the option to contact your card issuer if you funded your paypal payment that way and see if they will do a chargeback for you.

I'm not sure why nobody is understanding this issue.  The "seller" does not exist.  The "company" does not exist.  The tracking number provided is to a fake UPS page.   These products were Never delivered to this address because the UPS page is fake.   This is a very well thought out scam.  I really cannot believe the trouble I'm having getting my account credited.  Yes, I did email the "company" email address and guess what there was no answer because its a fake email.  

 

All anyone keeps telling me to contact the seller or the company both which are not real.  

 

I just don't understand.  I've never had a problem with Paypal before this.  My plan is as soon as I pay my balance off to cancel my account I'm honestly disgusted by their response.

If you actually READ my post, NOWHERE did i tell you to contact the seller.

I know how the scam works and have told loads of folks how to APPEAL as per above.

They have done so and got refunds.

So try 'understanding the issue' yourself and your welcome !!

Next time don't buy from China websites or Social Media ads.

Report away, won't make any difference.

You asked for advice and I took the time the time to give you advice.

Suggesting you do not buy tat from China is good advice, just not what you presumably wanted to hear.

As for not knowing it was from China, most Facebook ads are China based.

 

You did not read my first post properly and so replied rudely to me.

No problem I will make sure I add you to MY list to not help in the future.  

 

As for your sarcasm over my badges you are incorrect, Paypal gives the badges and personally i think they are pointless.

However as for helping people the kudos and solutions that I have reflect my help as they are given by the ''nice'' folks that I have helped.

 

But I guess giving yourself a solution is the only way you will get one  😉

So for the good advice I gave you in detail on how to appeal which you were so appreciative to get..........your welcome.
