Brought an item, never received it. Seller provided a tracking number that shows delivery date prior to date of purchase (lol) , Still PayPal denied claim saying it’s delivered, how can an item be delivered even before I intend to buy? What can I do

I am only a few days away from probably getting the same decision. Throughout the process I have felt something was not quite right. It feels like the entire process is automated and no humans ever get involved. The scammers seem to know this and as long as they provide "delivered advice" the automated service seems to accept it.

 

I am thinking that with such a high profile company as PayPal the press is the way to go as this is clearly a public interest story and they need to get their act together.

 

Just my thoughts!

PayPal is regulated by the FCA so that would seem to be a good place to start; it is where I will go next.

 

The FCA does not like people getting ripped off by scammers.

Your first step will always be to file a complaint to PayPal.

 

Explain what happened and give them a reasonable time (14 days) to review the circumstances and to respond to you. Advise them in your initial correspondence that if you do not hear from them by the deadline you will escalate the complaint to the FCA. The procedures are on the FCA website.

 

I am new to this forum and not sure how it all works but there must be a way of gathering together all persons with similar circumstances and approaching

firstly, PayPal and then the FCA if necessary as numbers of similar complaints will carry more weight.

 

Hopefully someone will pitch in here with some guidance on how to reach out to others to pull like cases together.

 

Like I said before, my case hasn't been determined yet but because the scam company has submitted bogus delivery confirmation I anticipate it will go the same way as yours.

 

Just tried to submit and was told to remove the FCA email link!! That doesn't bode well!

To submit an appeal on the dispute that was closed, PayPal asks that you obtain a detailed report from the shipper/courier (on their letterhead or some other form of official stationary) that includes the address the seller gave them for the shipment or that includes a statement mentioning your address and saying the item was delivered to a different address.
When you have that, contact PayPal via phone (log on to your account and click Contact at the bottom of the page, however that may not be an option at the moment due to covid), or via Facebook (send a Private Message to PayPal) or via Twitter (send a Direct Message to @AskPayPal) and say you want to appeal the denial of the dispute based on the shipper saying the item was delivered to a different address. Once it's submitted (you will be provided with directions on how to do that), the dispute will be reviewed further and a determination will be made.

I do not accept that PayPal has the right to pass the obligation for obtaining the evidence to the claimant.

 

If PayPal has made a determination in the first place based on submitted documents then it is for them to ascertain the veracity of those documents, not the claimant. This would seem to be yet another ploy to cause so much grief for the claimant that they simply give up.

Sorry? What kind of a response is that then?

 

You appear to me more concerned with being seen as the big I am rather than assisting people to deal with the problems they have.

 

If there is something wrong with what I have said then please say what it is but I have spent half a lifetime dealing with fraud and disputes and what I stated was my view based upon real time experiences.

 

Try to be helpful rather than obdurate.
