Can I claim legal action on someone whos scammed me through friends and family ?

You would need legal advice on that one and we are not lawyers.

However sending a family/friends payment is sending a GIFT of money.

That person does not have to supply anything as you were not buying anything, if you were then you would have used the goods/services option.
