"Label created" status for 9 days. Can I get a refund?

I purchased items from a seller from China and the UPS tracking number that was provided has been in "label created" status for 9 days.

I ship orders out every day and i know what label created status means but seller keeps giving me runaround. 

I was supposed to receive my order a week ago, but the order has not been shipped.

I filed a case with Paypal. What is my chance of getting a full refund?
